202001655 <br />11. "Lot" shall mean any one of Lots one (1) through thirty-seven (37) of Amick <br />Acres and any one of Lots one (1) through twenty-four (24) of Amick Acres 2nd <br />Subdivision, including Lots (1) ands (2) of the Eclipse Subdivision, formerly Lot (20) of <br />the Amick Acres 2nd Subdivision. <br />12. "Member" shall mean an Owner of any Lot(s) in the Amick Acres Subdivision <br />or the Amick Acres 2nd Subdivision, including Lots (1) ands (2) of the Eclipse <br />Subdivision, formerly Lot (20) of the Amick Acres 2nd Subdivision. <br />13. "Amick Acres Homeowner Association Rules" shall mean the rules adopted by <br />the Board pursuant to Articles II and III. <br />14. "Owner" shall mean the record owner, whether one or more persons or entities, <br />of a fee simple title to any Lot in the Amick Acres Subdivision, or the Amick Acres 2nd <br />Subdivsion, including Lots (1) ands (2) of the Eclipse Subdivision, formerly Lot (20) of <br />the Amick Acres 2nd Subdivision, and shall also include a person or persons or entities <br />under a recorded contract if the record owner executes a release and transfer of his or her <br />voting rights to the contract purchaser. In the case of Lots wherein the fee simple title is <br />vested of record in a trustee pursuant to Nebraska Revised Statutes, Section 30-2801 et. <br />seq., legal title shall be in the trustor. <br />15. "Special Assessment" shall mean an assessment for a "limited and specific <br />purpose," unlike an annual assessment which shall be part of the Homeowners <br />Association annual budget for the operation and maintenance of the association and <br />subdivisions. <br />16. "S bdivision(s) shall mean or refer to the original Amick Acres Subdivision and <br />the Amick Acres 2nd Subdivision and all Lots contained therein. <br />ARTICLE II. <br />COVENANTS, RESTRICTIONS, AND CONDITIONS <br />In consideration of the mutual benefits to be derived by the owners of the Amick <br />Acres Subdivision and the Amick Acres 2nd Subdivision, and any purchaser or <br />purchasers, their heirs, devisees, personal representatives and assigns, WE, as a requisite <br />majority of the Owners and Members, as set forth above, hereby stipulate and agree that <br />any and all Lots in the Amick Acres Subdivision and the Amick Acres 2nd Subdivision, <br />all as surveyed, platted and recorded in the office of the Register of Deeds, Hall County, <br />Nebraska that are sold, transferred and conveyed, shall be and are subject to the following <br />amended protective covenants, restrictions, and conditions, unless otherwise provided for <br />separately and differently below in this Article. All covenants, restrictions, and <br />conditions shall run with the land and are as follows: <br />1. Lots Affected. All lots in the Amick Acres and Amick Acres Second <br />Subdivisions, including Lots one (1) and two (2) of the Eclipse Subdivsion, (formerly Lot <br />20 of Amick Acres 2nd Subdivision) shall be known and described as residential lots. <br />
