202001655 <br />(hereinafter collectively termed "covenants and restrictions") which are for the purpose of <br />protecting the value and desirability of all lots in the Amick Acres and Amick Acres 2nd <br />Subdivisions, and which shall run with the real property and be binding on all parties <br />having any right, title, or interest in one of the Lots one (1) through thirty-seven (37) of <br />Amick Acres, and Lots one (1) through twenty-four (24), including Lots (1) and (2) of the <br />Eclipse Subdivision, or any part thereof, their heirs, successors and assigns, and which <br />shall inure to the benefit of each owner thereof. <br />ARTICLE I. <br />DEFINITIONS <br />The following words, phrases, or terms used in this Agreement for Covenants <br />shall have the following defmitions: <br />1. "Annual Assessment" shall mean the charge levied and assessed each year <br />against each Lot, Owner, or Lessee pursuant to Article III, paragraph 4 below. <br />2. "Articles" shall mean the Articles of Incorporation of the Association as the same <br />may from time to time be amended or supplemented. <br />3. "Assessment" shall mean the Annual Assessment, Special Assessment, and/or <br />Maintenance Charge. <br />4. "Assessment Lien" shall mean the lien created and imposed by Article III. <br />5. "Association" shall mean the Amick Acres Homeowners Association, Inc., a <br />Nebraska Nonprofit Corporation, for the lot owners of the Amick Acres Subdivision and <br />the Amick Acres 2nd Subdivision, and the lot owners of any subsequently subdivided lots <br />therein. <br />6. "Board" shall mean the Board of Directors of the Association. <br />7. "Bylaws" shall mean the Bylaws of the Association and any amendments or <br />supplements to such Bylaws. <br />8. "Common Area" shall mean Lot 10 (park lot) and Lot 37 (lake lot) of the Amick <br />Acres Subdivision, Lot 24 (lake lot) of Amick Acres 2nd Subdivision, and all <br />improvements hereafter constructed by the Association. <br />9. "Covenants" shall mean the Amended Agreement for Protective Covenants, <br />Restrictions and Conditions for the Amick Acres Subdivision and the Amick Acres 2nd <br />Subdivision of Hall County, Nebraska. <br />10. "Dwelling" shall mean any building or portion of a building situated upon a Lot <br />designed and intended for use and occupancy as a residence by a single family, or a Lot or <br />combination of Lots that may be designated by the Declarants for multiple family units, <br />townhouses, or condominiums. <br />
