<br />4. It is the desire and intention of Renee J. Amick and John W. Amick to deed the
<br />"common areas" listed above to an incorporated homeowners association, the Amick
<br />Acres Homeowners Association, Inc., a Nebraska NonProfit Corporation, for the Amick
<br />Acres and Amick Acres 2nd Subdivisions.
<br />5. At the time the original Agreements for Protective Covenants, Restrictions and
<br />Conditions for the Amick Acres and Amick 2nd Subdivisions, listed above, were signed
<br />and filed with the Hall County Register of Deeds, no provision in the covenants for either
<br />the Amick Acres Subdivision, or the Amick Acres 2nd Subdivision was made for an
<br />incorporated "Homeowners Association."
<br />6. The Amick Acres Subdivision and the Amick Acres 2nd Subdivision are
<br />adjacent to each other and share in the common use of the common areas, Lot #37 for
<br />Amick Acres, and Lot # 24 for Amick Acres 2nd Subdivision, (a.k.a., the "Lake Lots.)
<br />7. To amend the Protective Covenants for both the Amick Acres Subdivision and
<br />the Amick Acres 2nd Subdivision, a vote of a "majority" of the lot owners of each
<br />subdivision is required by each subdivision's existing convenants. That majority shall be
<br />the owners of not less than twenty-four (24) lots of the Amick Acres Subdivision, and the
<br />owners of not less than sixteen (16) lots of the Amick Acres 2nd Subdivision.
<br />8. It is the desire of at least a majority of the lot owners of the Amick Acres
<br />Subdivision, (owners of not less than twenty-four (24) lots), and the Amick Acres 2nd
<br />Subdivision (owners of not less than sixteen (16) lots) to revise and amend their
<br />Agreements for Protective Covenants, Restrictions and Conditions for the purposes of (1)
<br />Creating an incorporated homeowners association to take ownership of the "common
<br />areas" listed above, and (2) To maintain and improve the rules, regulations, and
<br />governance of the subdivisions.
<br />Therefore, in a vote of the property owners of the Amick Acres Subdivision and
<br />Amick Acres 2nd Subdivision, by written ballot, regarding the proposed Amended
<br />Agreement for Protective Covenants, as set forth in Articles I, II and III below, was
<br />approved and adopted at two Special Meetings of the homeowners, the first held on
<br />December 9, 2019, and the second on February 27, 2020.
<br />And, as a result of the above vote by the property owners of the Amick Acres
<br />Subdivision and Amick Acres 2nd Subdivision, this new and Amended Agreement for
<br />Protective Covenants shall be filed and recorded with the Register of Deeds of Hall
<br />County, Nebraska upon approval by the necessary majority of lot owners, and shall go
<br />into effect and become binding on all lot owners upon filing with the Hall County
<br />Register of Deeds.
<br />Finally, it is the intention of a requisite majority of the lot owners on the Amick
<br />Acres Subdivision and the Amick Acres 2nd Subdivision that Lots one (1) through
<br />thirty-seven (37) of Amick Acres Subdivision and Lots one (1) through twenty-four (24)
<br />of the Amick Acres 2nd Subdivision, including Lots (1) and (2) of the Eclipse
<br />Subdivision, shall be held, sold and conveyed subject to the following reservations,
<br />easements, limitations, restrictions, servitudes, covenants, conditions, charges, and liens
