201904287 <br />c. The expenditure, commitment and payment of Association funds to accomplish the <br />purposes of the Association including, but not limited to, the costs of operating the Association, <br />payment for the purchase of insurance covering the Commons against property damage and casualty, <br />the purchase of liability insurance coverages for the Association, the Board of Directors of the <br />Association and the Members, and the payment of taxes or governmental assessments as required or <br />necessary. <br />d. The exercise of all the powers and privileges, and the performance of all of the duties <br />and obligations of the Association as set forth in this Declaration, as the same may be amended from <br />time to time. <br />e. The acquisition by purchase or otherwise, holding, or disposition of any right, title or <br />interest in real or personal property, whenever located, in connection with the affairs of the <br />Association. <br />f. The deposit, investment and reinvestment of Association funds in bank accounts, <br />securities, money market funds or accounts, mutual funds, pooled funds, certificates of deposit or the <br />like. <br />g. The employment of professionals and consultants to advise and assist the officers and <br />Board of Directors of the Association in the performance of their duties and responsibilities for the <br />Association. <br />h. General administration and management of the Association, and execution of such <br />documents and doing the performance of such acts as may be necessary or appropriate to accomplish <br />such administration or management. <br />i. The doing and performing of such acts, and execution of such instruments and <br />documents, as may be necessary or appropriate to accomplish the purposes of the Association. <br />j. The interpretation and definition of terms used in the Covenants to promote the <br />purposes of the Association. <br />k. Assuring that the lots and units built thereon are maintained including lawn care and <br />exterior maintenance provided however such maintenance shall be at the cost of the homeowner. <br />1. Settling disputes between neighbors or party wall owners over the upkeep, repair or <br />restoration of lots or buildings thereon. <br />2. It shall be the general obligation and duty of the Association to properly maintain and <br />repairs all Common Areas, and recreational facilities, and all structures and improvements therein, or <br />a part of the common system in accordance with reasonable standards as generally required by the <br />City of Grand Island, and nothing in this Declaration shall be construed as any limitation upon the <br />authority of the City of Grand Island to enter upon said property and perform necessary maintenance <br />should the Association fail to do so, and to assess the property with the cost thereof. <br />ARTICLES IV <br />Property Rights in the Common Area <br />A. Each Member of the Association shall, as a member of the association, have the right to <br />use and enjoy the accessible Common Area, which shall be appurtenant to and shall pass with the <br />interest requisite for membership held by such member; provided, that no Lot Owner shall construct <br />any structures within the accessible Common Area without the prior written consent of the <br />Association.
