DMBG shall exercise this option by sending written <br />notice to the then title holder of the Lot within one hundred eighty (180) days <br />after the expiration of the above time frame or this option shall be considered <br />waived by DMBG as to the subject Lot. Notwithstanding the forgoing, DMBG's <br />option to repurchase a Lot shall not be applicable if such Lot has been purchased <br />by the owner of an adjacent Lot and construction of a single family residence has <br />commenced or been completed upon such adjacent Lot. <br />5. There shall be no town homes or condominiums built on any Lot. No basement <br />house or apartment may be built on any Lot. No individual dwelling consisting of <br />one level shall be constructed with less than one thousand five hundred fifty <br />(1,550) square feet of living area, not including the garage. No dwelling unit <br />consisting of a two -story design shall have less than one thousand four hundred <br />fifty (1,450) square feet of living area on the ground floor, not including the <br />garage. <br />6. No structure shall be erected, altered, placed or permitted to remain on any Lot <br />other than one dwelling, one private garage for not less than two (2), no more than <br />three (3) cars, and two out - buildings. No dwelling shall be erected for occupancy <br />by more than one family, nor shall any dwelling be used for occupancy of more <br />than one family. Any detached garage or other out - building shall be constructed <br />of the same quality and materials as the outside finish and roof of the residential <br />dwelling. <br />7. No flat or mansard roof shall be permitted on any dwelling. All dwellings shall be <br />roofed with wood shakes, wood shingles, or asphalt shingles. <br />8. No commercial or business enterprises shall be conducted or operated on any Lot <br />in the Subdivision. No Lot shall be divided or split to create smaller lots within <br />the Subdivision. Lots may be combined, or combined and divided to established <br />larger lots within the Subdivision. <br />9. No animals shall be kept, bred, or maintained for any commercial purpose on any <br />Lot within the Subdivision. No dog run shall be located in a front yard or within <br />twenty -five (25) feet of a side Lot line. <br />10. All wells, septic tanks, and leach fields on a Lot shall be placed more than fifty <br />(50) feet from any boundary line of said Lot. <br />11. No sod, earth, sand, or gravel shall be removed to the injury of the value or of the <br />appearance of any Lot, and no unused building material, junk, or rubbish shall be <br />Left exposed on any Lot except during actual construction. During construction, <br />the Lot under construction shall be maintained in a tidy manor. No trash fires will <br />be allowed on any Lot in the Subdivision. <br />12. No sign of any kind shall be displayed to public view on any Lot except one (1) <br />sign of not more than five (5) square feet advertising the property for sale or for <br />rent, or signs used by a builder to advertise the property during construction and <br />sales period, or signs by DMBG to advertise the Subdivision. <br />13. No worn out or disregarded automobiles, machinery, or parts thereof, shall be <br />stored on any Lot in the Subdivision and no portion thereof shall be used for <br />automobiles, junk piles or the storage of any kind of discarded items or waste <br />materials. <br />14. Certain easements are established for installation and maintenance of utilities and <br />drainage, such easements being clearly marked on the recorded plat of the <br />Subdivision. Utility service lines shall be kept underground. <br />15. Exposed antennas or aerials of any kind shall not be used except satellite dishes <br />which shall not exceed eighteen (18) inches in diameter. Such satellite dishes <br />must not be visible from the street which the front of the residence faces and must <br />be attached to the residence. No mercury or sodium vapor lights are allowed on <br />
