The foregoing recitals are incorporated herein by this reference. <br />1 <br />C..) <br />CD <br />C0 <br />WHEREAS, DMBG Investments, L.L.C., a Nebraska limited liability company, <br />( "DMBG ") is the owner of the following described real estate: <br />2. No Lot located within the Subdivision shall be used other than for single family <br />purposes. <br />AGREEMENT FOR RESTRICTIVE COVENANTS, RESTRICTIONS, <br />AND CONDITIONS FOR PRAIRIE CREEK MEADOWS SUBDIVISION, HALL COUNTY, <br />NEBRASKA <br />Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), Seven (7), Eight (8), and <br />Nine (9), Prairie Creek Meadows Subdivision, Hall County, Nebraska (hereinafter <br />separately referred to as "Lot" and collectively referred to as "Lots" or the "Subdivision ") <br />WHEREAS, it is the desire of DMBG to protect the value and desirability of each Lot <br />within the Subdivision by encouraging the construction of single family residences thereon. <br />In furtherance of this desire, each Lot within the Subdivision shall be held, sold and conveyed <br />subject to the reservations, easements, limitations, restrictions, servitudes, covenants, conditions, <br />charges and liens, (hereinafter collectively termed "covenants and conditions ") provided for <br />hereinbelow. <br />NOW, THEREFORE, in consideration thereof, and of the mutual benefits to be derived <br />by DMBG and the purchaser or purchasers of any Lot within the Subdivision, along with their <br />heirs, devisees, personal representatives, and assigns, DMBG stipulates and agrees that each Lot <br />within the Subdivision, shall be and are subject to the following covenants and conditions, all of <br />which shall run with the land: <br />3. No building or dwelling house shall be moved into the Subdivision and placed <br />upon any Lot. No mobile home shall be placed on any Lot. No trailer, tent - <br />garage, shack, or other unsightly out - buildings shall be used in the Subdivision as <br />a dwelling at any time, nor shall any structure of a temporary nature be used as a <br />residence. <br />4. Any building constructed upon any Lot located within the Subdivision shall be <br />completed within one (1) year from and after the commencement of construction. <br />In the event a building permit for a single family residence has not been issued by <br />the appropriate governmental authority and construction has not commenced on a <br />Lot within two (2) years from the date title to such Lot is transferred by DMBG or <br />its successors or assigns, shall have the option to repurchase said Lot for the <br />amount paid to DMBG for such Lot, minus closing costs paid by DMBG for the <br />
