any Lot (lighting installed by an appropriate governmental authority shall be <br />exempted from this lighting restriction). <br />16. No campers, trailers, motor or mobile homes, boats, recreational vehicles, busses, <br />or trucks (except one -half (1/2) ton pickup trucks) shall be parked or stored in <br />front of the residence on any Lot, except for loading and unloading purposes. <br />17. No fences shall be constructed on any Lot within the Subdivision of waste <br />material or any other unsightly material. Privacy fences must not exceed six (6) <br />feet in height. <br />201706956 <br />18. Each Lot owner shall be responsible for implementing and maintaining adequate <br />erosion control measures on the Lot. The adequacy of erosion control measures <br />on a Lot shall be subject to continual review during construction until sod or <br />seeding has been established on the Lot. DMBG shall have the right to require <br />any owner of a Lot to maintain silt fences, straw bales, or other additional <br />measures if soil is observed to be eroding onto abutting Lots, or into any road <br />ditch. <br />19. DMBG shall have exclusive right to establish grade and slopes for all Lots and to <br />fix the grade at which any building or other improvement shall be placed or <br />constructed upon any Lot. Once such grades, slopes, and/or contours have been <br />established by DMBG, they shall not be changed in connection with the <br />construction of any buildings or other improvement on a Lot without written <br />permission from DMBG, but in no event will such Lot be graded or sloped so as <br />to change the flow of surface water or from adjoining Lots. <br />20. Any solar panels or other supplementary or auxiliary energy saving type of device <br />placed on any residence constructed on any Lot shall be mounted flush with the <br />roof of such residence, and shall not be located along any exterior wall of such <br />residence nor in any yard area of any Lot. Provided, however, that no solar panels <br />or other supplementary or auxiliary energy saving type of device shall be place on <br />any single family residence constructed on any Lot without the prior written <br />approval of the DMBG. <br />21. These covenants and conditions shall run with the land and shall be binding upon <br />and enforceable by DMBG or any owner of a Lot and their respective heirs, <br />executors, administrators, successors and assigns. These covenants and <br />conditions may be terminated or modified, in writing, by the owners of Lots <br />owning at least two- thirds (2/3) of the Lots within the Subdivision, at any time. <br />22. The enforcement of these covenants and conditions shall be by proceedings at law <br />or in equity against any person or persons violating or attempting to violate any <br />provisions hereof. Such proceedings may be to restrain such violation or to <br />recover damages. <br />23.
