<br /> for and in the name of Tr�ustor and at Trustor's expense. Far such pu�pases, Trustor hereby irre�v�ably appofnts
<br /> Lender as Trustor's attorney-in-fact tar the purpase ❑f making, executing, deli�ering, filing, rec�rding, and doing all
<br /> other things as may be nec�ssary ❑r desirable, in Lender's sole apinion, to accamp�ish the matters re�e�red to +n
<br /> th� pr�ceding parag�aph.
<br /> FULL PERFDRMANCE. If Trustor pays al! the Indebtedness, including without limitation all future ad�ances, when due,
<br /> and otherwise performs aFl the ok�liga�ions imposed upfln Trustor under this Deed ❑f Trust, Lender shalf execute and
<br /> de�i�er ta Trustee a request f�r full recan�eyance and shall execute and deli�er to Trustor suitable stat�ments of
<br /> t�rmination vf any financing statement on �ife e�idencing Lender's security interes� in the Rents and the Persona!
<br /> Property. Any re�vn�eyance fee requ�red hy law shall be paid by Trustor, if permitt�d by appliGa�le law.
<br /> EVENTS �F DEFAIJLT. Each af the failowing, at Lender's option, shall c�nst�tute an E�ent of Default under this ❑eed
<br /> ofi Trust:
<br /> Paymen#Default. Trust�r fai�s t❑ make any paym�nt when due under�he Indehtedness.
<br /> Uther Defaults. Trustor fails t❑ comply with vr to perform any other term, abligation, co�enant or' �ondition
<br /> contained in this [�eed of Trust ❑r in any of th� Related Documents ❑r to comply with or t❑ perform any t�rm,
<br /> obligatian, co�enant or condition �ontained in any other agreem�nt between Lender and Trus�ar.
<br /> C�mpliance Default. Failure ta cnmpiy with any vther term, obligation, co�enant ar candition �ontained in �his
<br /> Deed of Trust, the No�e ar in any of the Related Documents.
<br /> Default on �ther Payments. Failure af Trustor within the tim� required by this ❑eed of Trust to make any payment
<br /> �ar taxes or insurance, ❑�any ather payment necessary to pre�ent filing af or to effect discharg� a� any lien.
<br /> Fa�se Statem�nts. Any warranty, representation or statement made ❑r furnished to Lender by Trustor ar an
<br /> Trustor's behaif under this Deed af Trust ar the ReEated Dflcurr}ents is fafse or misleading �n any materi�E respect,
<br /> either now ❑r at the time made ar furnished ar becames false or misleading at any time thereafter.
<br /> Defective Cv��atera�izati�n. This Deed flf Trust or any of the Related Qacuments �eases ta be in �uff #arce and
<br /> effect �including �ailure of any �allate�al document t❑ create a �a�id and perfected security interest or lien� at any
<br /> time and tar any reasan.
<br /> Death ❑r Insolvency. The death of Trustar, the insol�ency of Trustar, th� app�intment of a recei��r for any part of
<br /> Trustor's property, any assignment for the benefit ❑f creditars, any type ❑f creditvr warkout, or the
<br /> commencement vf any proceeding under any bankruptcy or insol�ency �aws by or against TrustQr.
<br /> Creditor or Forfeiture Rroceedings. Camm�n�ement of foreclasure ❑r farfeiture proceedings, whether by judiciaf
<br /> proceeding, self-help, repossession ❑r any other method, hy any �reditor�f Trustor or by any go�ernmental agen�y
<br /> agains� any prop�rty securing the lndebtedness. This includes a garnishment ot any ❑# Trustor's accoun�s,
<br /> including deposit accaunts, with Lender. Howe�er, this E�ent o� Default shall not apply if there is a good faith
<br /> dispute by Trus�ar as to the �alidity ar reas�nableness of the claim wh��h is th� basis ❑f the credit�r ar farfeiture
<br /> prnceeding and if Trustor gives Lender written notice of the creditor a� forfeiture proceeding and dep�sits with
<br /> Lender monies or a surety bond �or the �reditar �r f�rfeiture proceeding, in an amount determined by Lender, in i�s
<br /> soRe discretian, as being an adequate reser�e or band for the dispute.
<br /> Breach of�ther Agreement. Any �areach t�y Trustor under the terms of any other agr�ement betwe�n Trustor and
<br /> Lender that is nat remedied within any grace periad pro�ided therein, in�luding without limitation any agreement
<br /> concerning any indebtedness or ather obligation�f Trustor t� Lender, whether existing now �r Iater,
<br /> E�ents Af�ecting Guarantor. Any �f the pr�ceding events ac�urs with respect t❑ any guarantor, endarser, surety,
<br /> ❑r accammadati�n party of any �f the Indebtedness or any guarantor, endorser, surety, or a�commodation party
<br /> dies or bec�mes incompetent, or re�ol�es or disputes the �a�idity ❑f, or liabili�y und�r, any Guaranty ❑f the
<br /> Indebtedness.
<br /> Ad�ers� Change. A material ad�ers� change ❑ccurs in Trustor`s financia� candition, or Lende� belie��s the
<br /> prospect af payment or perfarman�e of the fndebtedness is impaired.
<br /> Insecurity. Lender in goad �aith belie�es itself insecure.
<br /> Existing lndebtedness. The payment of any installment at principal or any interest vn the Existing Indebtedness is
<br /> not made wifhin the time r�quired by the promissory nate e�idencing such ind�btedness, or a defauft occurs under
<br /> the instrum�nt securing such inc�ebtedness and is not cured during ariy applicable grace period �n such instrument,
<br /> ar any suit ar other a�tRan is �ammenced ta fareclase any existing fien an the Praperty.
<br /> Right to Cure. If any default, ❑ther than a default in payment, is curahle and if Trustar has not b�en gi�er� a noti��
<br /> of a brea�h ❑f the same provisian o�this ❑e�d ❑f Trust within the pre�eding twel�e ���] mon�hs, it may be cured if
