<br /> amend�d, extended, ❑r renewed without the priar written �ansent of Lender. Trustar shall neither request nor
<br /> accept any future ad�ances under any such security a�reement withaut the prior written consent vf Lender.
<br /> CflNDE1VINATIQN. The f�llowing pro�isions relating t� condemnation pro�eedings are a part of this Deed of Trust:
<br /> P�oceedings. If any proceeding in condemnation is filed, Trustvr shall promptly notify Lender in writing, and
<br /> Trust�r shalf promptly take su�h steps as may be necessar� to defend the action and abtain the award. Trustor
<br /> may �e the nominal party in such prviceeding, but Lender shaf� be enti�led t❑ participate in the praceeding and to be
<br /> represented in the praceeding by caunsel ❑f its �wn chaice, and Trustor will deli�er ❑r �ause t❑ be deli�ered to
<br /> Lender such instruments and do�umentation as may be requested by Lender frvm time to time to permit such
<br /> participation.
<br /> Applicatian vf Net Proceeds. If all ar any part of the Praperty is condemned by eminent domain proceedings or by
<br /> any pro��eding or purchase in I�eu vf condemnation, Lender may at its ele�tion require that al! flr any pvrtion of the
<br /> net proceeds ❑f the award be app�ied to the Indebtedness or the repair or restaration o# the Property. The net
<br /> pro�eeds af the award shall mean the award after payment ❑f all reasonabfe �asts, expenses, and attorneys' fees
<br /> in�urred by Trustee �r Lender in connection with th� condemnation.
<br /> IMPQSITI�N �F TA�CES, FEES AND CHARGES BY ��VERNMENTAL AUTHORIT[E5. The fallowing pro�isions relating
<br /> t❑ go�ernrr�ental taxes, fees and �harges are a part of this Deed ❑f Trust:
<br /> Curr�nt Taxes, Fees and Charges. Up�n request by Lender, Trustar shal� execute such dr�cuments in addition to
<br /> this ❑�ed at Trust and take whatever other actinn is requested by Lender ta perfect and �antinue Ler�der's lien �n
<br /> the Real Property. Trustor shall reim�urs� Lender for ail taxes, as des�ribed below, togeth�r with all expenses
<br /> incurred in re�arding, perfecting or cont�nuing this Deed ❑f Trust, including without limitativn all taxes, fees,
<br /> dflcu�r►entary stamps, and ather�harges far r��arding ❑� registering this Deed of Trust.
<br /> Taxes. The fo�fowing shall constitute taxes to which this section applies: �17 a specific tax upon this type of
<br /> Deed of Trust ❑r upon all or any part ❑f the Indebtedness secured by this Deed vf Trust; t27 a specEf�c tax on
<br /> Trustor which Trustor is autharized or required to deduet�rom payments on the lndebtedness secured by this type
<br /> of Deed of Trust; 43} a tax on this type ❑f Deed of Trust chargeable against the Lender or the holder of the Nvte;
<br /> and ��� a specifi�c tax on a�l or any partian of the Indebtedness or ❑n payments af principal an� interest made by
<br /> Trustar.
<br /> 5ubsequent Taxes. If any tax t❑ whjch �his section applies is ena�ted su�sequent t� the date ❑f this Deed of
<br /> Trust, this e�ent shall ha�e the same e�fect as an E�ent af Default, and Lender may exercise any or alI of its
<br /> a�ailable remedies for an E�ent of ❑efault as pra�ided belaw unless Trust�r either ��y pays the tax before it
<br /> becomes delinquent, ❑r �27 contests the tax as pra�ided abo�e in the Taxes and Liens sectivn and d�posits with
<br /> Lender cash ar a sufficient carpnrate surety bond ❑r other security satisfactory to Lender.
<br /> SECURITY AGREEMENT; FINANCING STATEMENTS. The f�llowing pro�isions relating to this ❑eed of Trust as a
<br /> security agreement are a part�f this Deed ❑f Trust:
<br /> 5e�uri�y Agreement. This instrument sha�� canst�tute a Security Agreement t❑ the ext�nt any of �he Property
<br /> constitutes fixtures, and Lender shall ha�e a�f vf the rights ❑f a secured party under the Uniform Commer�iai Code
<br /> as amended fram time t❑time.
<br /> Security Interest. Upon request by Lender, Trustor shall take whate�er action is requested by Lender to perfect
<br /> and c�ntinue Lender's security interest in the Rents and Persanal Property. !n additian ta reGording this �eed af
<br /> Trust in the real property recards, Lender may, at any time and withaut further authorization from Trustor, fife
<br /> exe�uted counterparts, copies or reproductions af this Deed af Trust as a financing statement. Trustor shall
<br /> reimburse Lender for all expenses incur�ed in perfectin� ar cantinuing th�s security interest, Upon defau�t, Trustar
<br /> shall not remo�e, se�er or detach the Personai Property #rom the Pr�perty, Upon default, Trustor shafl assemb�e
<br /> any Personal Property not affixed ta the Property in a manner and at a place reasonably con�enient to Trustor and
<br /> Lender and make it a�ailable to Lender within three �3� days after receipt �f written demand from Lender tv the
<br /> ex�ent permitted by applicable law.

<br /> FURTHER ASSURANCES; ATT�RNEY-IN-FACT. The fallowing pro�isians relating ta further assurances and
<br /> attorney-in-fac� are a part�f this Deed ❑f Trust:
<br /> Further Assurances. At any time, and from time to time, upon request of Lender, Trustor will make, exe�ute and
<br /> deli�er, a� will cause tv be made, sxecuted or deli�ered, to Lender or to Lend�r's designee, and when requested by
<br /> LendPr, �ause to be filed, re�orded, ref�led, ❑r rerecorded, as the case may be, at su�h times and in such ❑ffices
<br /> and places as Lender may deem appropriate, any and al1 such martgages, deeds ❑f trust, securEty deeds, se�urity
