201702574 <br />7. "OWNER" shall mean the record owner, whether one or more persons or entities, <br />of a fee simple title to any lot, and shall also include a person or persons or entities under a <br />recorded contract if the record owner executes a release and transfer of his or her voting rights to <br />the contract purchaser. Others having an interest merely as security for performance of an <br />obligation are not considered owners. In the case of lots wherein the fee simple title is vested of <br />record in a trustee pursuant to Nebraska Revised Statues, §30 -2801 et. seq., legal title shall be in <br />the trustor. <br />Article IV. <br />COVENANTS, RESTRICTIONS AND CONDITIONS <br />A. Lot Provisions <br />1. COVENANTS TO RUN WITH THE LAND. In consideration of the mutual <br />benefits to be derived by the Owners of the Lots identified at Article II. hereinabove and any <br />purchaser or purchasers, their heirs, devisees, personal representatives, successors, assigns or <br />grantees, the Declarant stipulates and agrees that all of said Lots, along with any part or <br />subsequent re- subdivision thereof, shall be and are subject to the following restrictive covenants, <br />restrictions and conditions provided herein. All restrictive covenants, restrictions and conditions <br />shall run with the land. <br />2. ACCEPTANCE. Each Owner of any Lot contained agrees to these Covenants, <br />Restrictions and Conditions by acceptance of any conveyance of any Lot, or any portion thereof, <br />including subsequent lots created by a subsequent re- subdivision of these current lots whether or <br />not it is so expressed in any such conveyance. <br />3. RESIDENTIAL USE. All Lots shall be known and described as residential. No <br />multiple dwelling units and no more than one residential structure shall be allowed on any Lot. <br />No dwelling shall be occupied by more than one family. No commercial or business enterprise <br />shall be conducted or operated on any Lot; provided, however, personal offices within homes <br />shall be permitted. Only one additional structure may be located on each lot in addition to the <br />residential structure. <br />4. TEMPORARY STRUCTURES AND OTHER PROHIBITIONS. No trailer, <br />converted trailer, campers, motor home, mobile home, manufactured home, modular constructed <br />home, basement, tent, garage, shack, accessory building, or other unsightly outbuilding shall be <br />erected and/or used as a dwelling any Lot, nor shall any structure of a temporary character be <br />used as a residence. No unused building materials, junk or rubbish shall be left exposed on any <br />Lot except during actual building operations. No farm equipment shall be stored or placed on the <br />property. <br />5. ARCHITECHTURAL CONTROL. The Association or its designated committee <br />(the "Architectural Control Committee ") shall have general architectural control over any <br />construction upon a Lot in accordance with the following provisions: <br />4 <br />
