12 <br />201702574 <br />2. VOTING. The Association shall have one class of voting membership, which shall include <br />each Owner of a Lot. One (1) vote shall be allocated to each Lot, which shall be exercised by the <br />member owning such Lot. When more than one (1) person or entity holds an interest in any Lot, <br />all such persons or entities shall be members of the Association but any vote for such Lot shall <br />be exercised as they among themselves determine with no more than one (1) vote being cast with <br />respect to any single Lot. Voting privileges are restricted to paid -up members only. In the event <br />that any single Lot is subsequently re- subdivided or otherwise developed into separate living <br />units, such as a condominium regime involving multi - family residential structures, any reference <br />to "Lot" herein shall be equivalent as referring to each separate living unit. <br />3. ENFORCEMENT OF MAINTENANCE REQUIREMENTS. If any Owner fails <br />or refuses to perform any required maintenance or general maintenance obligations, the <br />Association, after seven (7) days' notice to the Owner in default, may perform the required work <br />or maintenance. The actual cost of performing the work or maintenance, together with a ten <br />percent (10 %) administrative fee shall be the personal obligation of the Owner who is or was the <br />owner of the lot failing to perform required maintenance or general maintenance, and such <br />obligation shall bear interest at the rate of fourteen percent (14 %) per annum and shall be a lien <br />upon the lot assessed by the filing of notice thereof in the Office of the Hall County Register of <br />Deeds. <br />4. ENFORCEMENT OF IMPROVEMENT RESTRICTIONS. If any Owner fails or <br />refuses to comply with the restrictions herein regarding improvements, including dwelling <br />structure, the Association, after seven (7) days' notice to the Owner may cause such <br />improvement to be removed and assess the actual cost of such removal, together with a ten <br />percent (10 %) administrative fee, against the Owner, and such obligation shall bear interest at the <br />rate of fourteen (14 %) per annum and shall be a lien upon the lot assessed by the filing of notice <br />thereof in the Office of the Hall County Register of Deeds. <br />5. REMEDIES AT LAW. If any Owner fails or refuses to comply with any of the <br />Restrictive Covenants, Restrictions and Conditions contained herein, the Association may, in <br />addition to the remedies provided herein, utilize any and all legal and equitable remedies <br />available to it to enforce said Restrictive Covenants, Restrictions and Conditions. <br />6. SERVICES OF ASSOCIATION. In addition to enforcing the provisions of these <br />covenants, the Association shall provide such other services to the Owners as determined from <br />time to time by the Owners of a majority of the Lots, and to the extent required by the <br />Association, its agents, and employees shall have a license to enter upon each Owner's Lot as <br />may be reasonably necessary in order to perform these services. The Association specifically <br />shall provide certain services relating to the Lake, which may include, but are not limited to, the <br />following: (a) general maintenance of the physical properties and general appearance and <br />condition of Lake, the fountain, and all items incidental thereto as the Owners determine; (b) <br />payment of any taxes or special assessments levied by any governmental body regarding Lake; <br />or (c) payment and maintenance of one or more insurance policies to adequately insure against <br />those risks naturally arising out of the ordinary use of Lake, including property damage or bodily <br />injury. Any and all maintenance, insurance, repair, replacement insurance and utilities for the <br />Lake shall be the responsibility o f and paid by the Association. <br />7. THIRD PARTY SERVICES. The Association is specifically authorized <br />hereunder to contract with any third party to perform the services of the Association hereunder. <br />
