•r . <br />200004452 <br />REAL ESTATE AGREEMENT <br />THIS AGREEMENT made and executed this Z\ day of January, 2000, <br />by and between Amick Acres East Subdivision, hereinafter referred <br />to as "SELLER" and Carl Amick, Renee Amick, and Lillian Amick, in <br />their capacity as developers of Amick Acres West Subdivision, <br />hereinafter referred to as "BUYER." <br />WITNESSETH: <br />WHEREAS, the Seller desires to sell to Buyer, and the Buyer desires <br />to purchase from Seller two certain easements on the real estate <br />commonly known as Lot 71 and Lot 8 of Amick Acres West Subdivision <br />shown as Exhibit 1 attached hereto and incorporated by reference; <br />WHEREAS, the parties hereto wish to provide ingress and egress to <br />said lots of Amick Acres West Subdivision by and through Sonja <br />Drive, Doniphan, Nebraska. <br />NOW, THEREFORE, in consideration of the mutual covenants herein <br />contained, IT IS AGREED: <br />1. Purchase Price: The Buyer agrees to pay to Seller, and Seller <br />agrees to accept from Buyer the sum of $10,628.84 as the total <br />purchase price for the above - described two certain easements and <br />all other property hereinafter set forth. <br />2. Payment of the Purchase Price: Concurrently with the execution <br />of this Agreement, Buyer has paid to Seller the sum of $10,628.84, <br />which sum shall be held in escrow at the Bank of Doniphan, <br />Nebraska. Said funds shall be released from escrow upon final <br />approval of the replat of Lots 71, 8, and 9, Amick Acres West <br />Subdivision, by the Hall County Board of Supervisors. In the event <br />the Buyers fail in their request before the proper governmental <br />entities to effectuate the intent of this agreement, Buyer shall be <br />entitled to a full refund of the purchase price held in escrow. <br />E HIBIT <br />
