200004459 <br />EASEMENT <br />That Grantor, Amick Acres East Subdivision Homeowner's Association, in consideration <br />of the real estate agreement made and executed the 21st day of January, 2000, by and <br />between the Amick Acres East Subdivision, and Carl Amick, Renee Amick, and Lillian <br />Amick, as developers of the Amick Acres West Subdivision, (a copy of which is attached <br />to this easement and marked "Exhibit A ") hereby, grants and conveys to Carl Amick, <br />Renee Amick, and Lillian Amick, Grantee, and their successors, heirs, and assigns, a <br />permanent and perpetual easement and right -of -way of ingress and egress to drive upon, <br />over, along, and across a certain tract of land known as Sonja Drive, Doniphan, Hall <br />County, Nebraska to Lots One (1) and Two (2) of Amick Acres West Second Subdivision, <br />formerly known as Lots S venty -One (71) and Eight (8), Amick Acres West Subdivision, <br />Hall County, Nebraska. (gsoNSA Dole /s Oui'1or eA17- <br />In consideration thereof, the owners of said lots shall be subject to and responsible for <br />the following: <br />1. Special assessments which Amick Acres East Homeowner's Association or its <br />board may approve, including, but not limited to paving of roads or improvement <br />projects, water and sewer projects, beautification projects, or assessments common to <br />all members of Amick Acres East Homeowner's Association. <br />2. The obligation to abide by the restrictive covenants of both Amick Acres East <br />Subdivision and Amick Acres West Subdivision and in the event of a conflict of <br />covenants, the most restrictive provision of either covenant shall be of force and effect. <br />The owners of said lots shall be required to pay annual dues to Amick Acres East <br />Homeowner's Association in a similar sum to other Amick Acres East Homeowners. The <br />owners of said lots shall maintain membership and exercise voting rights in Amick Acres <br />West Homeowner's Association and with no other subdivision. <br />3. Amick Acres East Subdivision is given final and binding review of any <br />improvements constructed or placed on said lots. There shall be no multi - family or <br />condominiums constructed or placed on said lots.
