Final Grading, Ponding, Farm Ponds -- Final grading of the Parcel shall occur as <br />soon as possible following completion of the dwelling to provide for adequate drainage from the <br />Parcel and to prevent any ponding on adjacent and/or contiguous Tracts. At no time shall the <br />grading, or a lack of grading on any Tract, cause the ponding of water on adjacent and/or <br />contiguous Tracts. Dams, or farm ponds, are permitted on the Tracts with the prior written <br />consent of the Declarants. <br />m. Landscaping Requirments, Deadline -- All landscaping, including the installation <br />of driveways and sidewalks, must be done in a professional manner and completed not later than <br />nine months following the completion of the dwelling. <br />n. Clearance of Construction Materials -- Upon completion of the dwelling, all <br />debris, brick piles, and other construction materials shall be cleared from the Tract. <br />p. Fences, Encl cures All privacy fences and enclosures shall be approved by the <br />declarants prior to construction. <br />q. Construction Rules for Contractors -- The Declarants shall compile a list of <br />construction rules, applicable during the constuction period, for the homeowner and the <br />contracting builders, which shall be signed and made a part of its approval in writing between the <br />Declarants and the Tract owner. As needed, the Declarants may alter, amend, or impose <br />additional construction rules that it may deem necessary to address any problems unforeseen at <br />the time of approval. <br />r. Removal of Earth, Changes in Elevation -- No earth shall be removed from the <br />Tract which may cause injury to the value or appearance of any Tract, or for any commercial <br />purpose, unless approved in writing by the Declarants. Any change in the elevation of a Tract <br />must be approved in writing by the Declarants prior to grading. <br />S. Setback Requirements. Unless otherwise agreed to and approved by the Declarants, any <br />dwelling and all outbuildings shall be constructed within the middle third of the Tract, unless <br />agreed to in writing by the Declarants during the construction approval process. All site plans for <br />the construction of the dwelling and any outbuildings shall be submitted to the Declarants for <br />their approval prior to the start of construction. <br />6. Building Codes. <br />a. All construction and building shall be so performed that it will comply with the <br />requirements of the building codes and ordinances of Hall County, and the State of Nebraska. <br />b. Placement of the well and septic systems shall be subject to a Master Well and <br />Septic System Plan and shall require the approval by the Declarants prior to installation. All <br />private wells, septic systems shall be constructed or maintained in a manner that is <br />environmentally friendly, and in accordance with all Federal, State and County rules and <br />regulations affecting private wells and septic systems. <br />7. <br />a. Single - Family Residence, Square Footage Requirement, -- Each Tract shall have <br />no more than one (1) single - family residential dwelling thereon. Each dwelling shall have a <br />minimum of eighteen hundred (1,800) square feet which shall include all space within the <br />dwelling, but not include the square footage of the garage, open porches, or basements. <br />b. Garage Requirments, Size, Closure -- Each residence shall a garage large enough <br />for at least two, but not more than four vehicles. At least one stall within the garage, or an <br />separate barn, garage, or storage building shall be large enough to accommodate an extended cab <br />pickup, of not less than 24 feet in length. Except when in use, garage doors shall remain closed <br />at all times. <br />
