<br />17. The owner of each lot shall keep the vegetation and
<br />grass thereon cut to a height less than eight (8) inches prior to
<br />construction, and shall keep the shrubs, vegetation and grass
<br />thereon cut to a reasonable height after construction. There
<br />shall be no cottonwood trees planted.
<br />18. No fences shall be constructed, on any lot in the sub-
<br />division, of barbed wire, woven wire, or creosote - treated posts
<br />above ground or any other unsightly material. Privacy fences may
<br />not exceed six (6) feet in height.
<br />19. All public sidewalks shall be constructed to comply
<br />with the requirements of the building codes and ordinances of the
<br />City of Grand Island, Nebraska and shall have the edge of such
<br />sidewalk furthest from the street one (1) foot inside the street
<br />right -of -way unless otherwise required or permitted by the
<br />building codes and ordinances of the City of Grand Island,
<br />Nebraska. The acceptance of a deed of conveyance by any
<br />purchaser or purchasers of any lot or lots shall be construed as
<br />consent thereto. Such sidewalks will be constructed not later
<br />than the time the home is built and earlier if required by the
<br />building codes and ordinances of the City of Grand Island,
<br />Nebraska.
<br />20. Any owner of any lot, or their heirs, devisees, per-
<br />sonal representatives, successors, assigns or grantees, of Lots
<br />One (1) through Six (6), Block Three (3) or Lots One (1) through
<br />Eight (8), Block Four (4), all in Summerfield Estates First Sub-
<br />division in the City of Grand Island, Hall County, Nebraska shall
<br />be subject to a separate DECLARATION OF RESTRICTIVE COVENANTS,
<br />RESTRICTIONS AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVI-
<br />SION HOMEOWNERS' ASSOCIATION. No owner of Lots One (1) through
<br />(4), Block One (1), Lots One (1) through Eight (8), Block Two (2)
<br />or Tract "A ", all in Summerfield Estates First Subdivision in the
<br />City of Grand Island, Hall County, Nebraska, shall be subject to
<br />the separate DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS
<br />AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION
<br />HOMEOWNERS' ASSOCIATION. Such separate DECLARATION OF RESTRIC-
<br />TIVE COVENANTS, RESTRICTIONS AND COVENANTS FOR SUMMERFIELD
<br />ESTATES FIRST SUBDIVISION HOMEOWNERS' ASSOCIATION shall provide
<br />for the formation of a homeowners' association by the Owner to be
<br />known as "Summerfield Estates First Subdivision Homeowners'
<br />Association" and for the determination by the Board of Directors
<br />of the homeowners' association to be formed by the Owner known as
<br />"Summerfield Estates First Subdivision Homeowners' Association"
<br />of assessments on owners of any lot, or their heirs, devisees,
<br />personal representatives, successors, assigns or grantees, of
<br />Lots One (1) through Six (6), Block Three (3) or Lots One (1)
<br />through Eight (8), Block Four (4), all in Summerfield Estates
<br />First Subdivision in the City of Grand Island, Hall County,
<br />Nebraska. No owner of Lots One (1) through (4), Block One (1),
<br />Lots One (1) through Eight (8), Block Two (2) or Tract "A ", all
<br />in Summerfield Estates First Subdivision in the City of Grand
<br />Island, Hall County, Nebraska, shall be a member of the homeown-
