20000341E <br />ers' association to be formed by the Owner to be known as <br />"Summerfield Estates First Subdivision Homeowners' Association" <br />nor subject to any assessment by the Board of Directors of the <br />homeowners' association to be formed by the Owner to be known as <br />"Summerfield Estates First Subdivision Homeowners' Association ". <br />Such separate DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS <br />AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION <br />HOMEOWNERS' ASSOCIATION may be changed or modified by the owners <br />of Lots One (1) through Six (6), Block Three (3) and Lots One (1) <br />through Eight (8), Block Four (4), all in Summerfield Estates <br />First Subdivision in the City of Grand Island, Hall County, <br />Nebraska according to the terms of the separate DECLARATION OF <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND COVENANTS FOR SUMMERFIELD <br />ESTATES FIRST SUBDIVISION HOMEOWNERS' ASSOCIATION. No change or <br />modification of the separate DECLARATION OF RESTRICTIVE <br />COVENANTS, RESTRICTIONS AND COVENANTS FOR SUMMERFIELD ESTATES <br />FIRST SUBDIVISION HOMEOWNERS' ASSOCIATION shall require the <br />approval of any owner of Lots One (1) through (4), Block One (1), <br />Lots One (1) through Eight (8), Block Two (2) or Tract "A ", all <br />in Summerfield Estates First Subdivision in the City of Grand <br />Island, Hall County, Nebraska. The association to be formed by <br />the Owner to be known as "Summerfield Estates First Subdivision <br />Homeowners' Association" shall take all action to care for the <br />islands located on Summerfield Avenue and on Meadow Way Trail. <br />The owners of Lots One (1) through (4), Block One (1) and Lots <br />One (1) through Eight (8), Block Two (2), all in Summerfield <br />Estates First Subdivision in the City of Grand Island, Hall <br />County, Nebraska shall take all action to care for the island <br />located on Meadow Road. <br />21. These restrictive covenants, restrictions and condi- <br />tions are to run with the land and shall be binding on all per- <br />sons and all parties claiming ownership of said lots, until <br />January 1, 2010 at which time these Restrictive Covenants, Re- <br />strictions and Conditions shall be automatically extended for <br />successive periods of ten (10) years, unless changed or modified <br />by a vote of a majority of the then owners of the lots in said <br />subdivision. <br />22. If any owner of any lot, or their heirs, devisees, per- <br />sonal representatives, successors, assigns or grantees, shall <br />violate any of the restrictive covenants, restrictions and condi- <br />tions herein set forth, it shall be lawful for any other person <br />or persons owning any real estate in said subdivision to prose- <br />cute such proceedings at law or in equity against the person or <br />persons violating or attempting to violate any such restrictive <br />covenants, restrictions or conditions and to prevent him from so <br />doing or to recover damages for such violations. <br />23. If any of the restrictive covenants, restrictions or <br />conditions herein set forth are violated and declared void by a <br />court of competent jurisdiction, the remaining restrictive cove- <br />nants, restrictions and conditions shall not be affected, but <br />shall stay and remain in full force and effect. <br />D <br />
