200003419 3. All construction and building shall be so performed that it will comply with the requirements of the building codes and ordinances of the City of Grand Island, Nebraska. 4. No building or dwelling house shall be moved into said subdivision and placed upon a lot. No pre -fab, modular or mobile home shall be placed on a lot; no trailer, tent, garage, shack or any other unsightly out building shall be used in said subdivi- sion as a dwelling at any time, nor shall any structure of a tem- porary nature be used as a residence. 5. No barns, chicken houses, house trailers, commercial work or sales shops, or other buildings for the care and housing of fowl, rabbits or livestock shall be placed, maintained or used on any lot; nor shall any fowl, rabbits or animals other than household pets be kept upon any lot, and household pets shall not be kept, bred or maintained for any commercial purposes. No nox- ious or offensive activity shall be permitted on any lot nor shall there be anything done thereon which may become an annoy- ance or nuisance to the neighborhood. 6. Lots One (1) through Six (6), Block Three (3) and Lots One (1) through Eight (8), Block Four (4), all in Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska may include townhomes or condominiums and shall be subject to a separate DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION HOMEOWNERS' ASSOCIATION as provided in Article III., Paragraph 20 hereof. There shall be no townhomes or condominiums on Lots One (1) through (4), Block One (1) and Lots One (1) through Eight (8), Block Two (2). No basement house or apartment may be built on any lot. Except for townhomes or condominiums, no individual dwelling consisting of one level shall be constructed with less than 1250 square feet of living area, not including the garage. No dwelling consisting of a two story design shall have less than 900 square feet of living area on the ground floor, not including the garage. Townhomes or condominiums shall include a minimum of 900 square feet of living space, not including the garage. 7. No structure shall be erected, altered, placed or per- mitted to remain on any lot other than one dwelling, and private garage for not less than two (2) nor more than three (3) cars, for each private dwelling, and other secondary buildings inciden- tal to the residential use of the lot. No dwelling shall be erected for occupancy by more than one family, nor shall any dwelling be used for occupancy of more than one family. 8. No commercial or business enterprises shall be con- ducted or operated in said subdivision except in regard to Tract "A ". No lot or lots shall be divided or split to create smaller building areas. Lots may be combined, or combined and divided, to establish larger building areas. 3
