200003419 <br />3. All construction and building shall be so performed <br />that it will comply with the requirements of the building codes <br />and ordinances of the City of Grand Island, Nebraska. <br />4. No building or dwelling house shall be moved into said <br />subdivision and placed upon a lot. No pre -fab, modular or mobile <br />home shall be placed on a lot; no trailer, tent, garage, shack or <br />any other unsightly out building shall be used in said subdivi- <br />sion as a dwelling at any time, nor shall any structure of a tem- <br />porary nature be used as a residence. <br />5. No barns, chicken houses, house trailers, commercial <br />work or sales shops, or other buildings for the care and housing <br />of fowl, rabbits or livestock shall be placed, maintained or used <br />on any lot; nor shall any fowl, rabbits or animals other than <br />household pets be kept upon any lot, and household pets shall not <br />be kept, bred or maintained for any commercial purposes. No nox- <br />ious or offensive activity shall be permitted on any lot nor <br />shall there be anything done thereon which may become an annoy- <br />ance or nuisance to the neighborhood. <br />6. Lots One (1) through Six (6), Block Three (3) and Lots <br />One (1) through Eight (8), Block Four (4), all in Summerfield <br />Estates First Subdivision in the City of Grand Island, Hall <br />County, Nebraska may include townhomes or condominiums and shall <br />be subject to a separate DECLARATION OF RESTRICTIVE COVENANTS, <br />RESTRICTIONS AND COVENANTS FOR SUMMERFIELD ESTATES FIRST <br />SUBDIVISION HOMEOWNERS' ASSOCIATION as provided in Article III., <br />Paragraph 20 hereof. There shall be no townhomes or condominiums <br />on Lots One (1) through (4), Block One (1) and Lots One (1) <br />through Eight (8), Block Two (2). No basement house or apartment <br />may be built on any lot. Except for townhomes or condominiums, <br />no individual dwelling consisting of one level shall be <br />constructed with less than 1250 square feet of living area, not <br />including the garage. No dwelling consisting of a two story <br />design shall have less than 900 square feet of living area on the <br />ground floor, not including the garage. Townhomes or <br />condominiums shall include a minimum of 900 square feet of living <br />space, not including the garage. <br />7. No structure shall be erected, altered, placed or per- <br />mitted to remain on any lot other than one dwelling, and private <br />garage for not less than two (2) nor more than three (3) cars, <br />for each private dwelling, and other secondary buildings inciden- <br />tal to the residential use of the lot. No dwelling shall be <br />erected for occupancy by more than one family, nor shall any <br />dwelling be used for occupancy of more than one family. <br />8. No commercial or business enterprises shall be con- <br />ducted or operated in said subdivision except in regard to Tract <br />"A ". No lot or lots shall be divided or split to create smaller <br />building areas. Lots may be combined, or combined and divided, <br />to establish larger building areas. <br />3 <br />
