200003416 <br />Block Two (2); Lots One (1) through Six (6), Block Three (3); <br />Lots One (1) through Eight (8), Block Four (4) and Tract "A ", all <br />in Summerfield Estates First Subdivision in the City of Grand <br />Island, Hall County, Nebraska. <br />III. <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />In consideration of the mutual benefits to be derived by the <br />Owner of Summerfield Estates First Subdivision in the City of <br />Grand Island, Hall County, Nebraska, and any purchaser or pur- <br />chasers, their heirs, devisees, personal representatives, succes- <br />sors, assigns or grantees, the Owner stipulates and agrees that <br />all lots in Summerfield Estates First Subdivision in the City of <br />Grand Island, Hall County, Nebraska, that are sold, transferred <br />or conveyed, shall be and are subject to the following restric- <br />tive covenants, restrictions and conditions except as provided <br />herein. All restrictive covenants, restrictions and conditions <br />shall run with the land and are as follows: <br />1. Tract "A" in Summerfield Estates First Subdivision in <br />the City of Grand Island, Hall County, Nebraska shall not be sub- <br />ject to this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS <br />AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION IN THE <br />CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA except as contained <br />in this Article III., Paragraph 1. The only restrictive cove- <br />nants, restrictions and conditions as to Tract "A" in Summerfield <br />Estates First Subdivision in the City of Grand Island, Hall <br />County, Nebraska are as follows: <br />a. If any building or structure is constructed <br />on Tract "A", the owner of such building or structure <br />on Tract "A ", shall construct and maintain a wall ap- <br />proximately six (6) feet in height constructed of a ma- <br />son material of brick or block as a barrier between the <br />building or structure on Tract "A" and the residential <br />lots adjacent to the north of Tract "A" consisting of <br />Lots Four (4) through Eight (8), Block Two (2) in <br />Summerfield Estates First Subdivision in the City of <br />Grand Island, Hall County, Nebraska; and <br />b. Prior to the initial construction of the wall <br />described in Article III. Paragraph 1.(a) hereof, the <br />owner of such building or structure on Tract "A" shall <br />obtain the preapproval of materials to be used in con- <br />structing the wall described in Article III. Paragraph <br />1.(a) hereof by Owner, which preapproval shall not be <br />unreasonably withheld by Owner. <br />2. All lots in the subdivision shall be known and de- <br />scribed as residential lots with the exception of Tract A. <br />
