III. RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS In consideration of the mutual benefits to be derived by the Owner of Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska, and any purchaser or pur- chasers, their heirs, devisees, personal representatives, succes- sors, assigns or grantees, the Owner stipulates and agrees that all lots in Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska, that are sold, transferred or conveyed, shall be and are subject to the following restric- tive covenants, restrictions and conditions except as provided herein. All restrictive covenants, restrictions and conditions shall run with the land and are as follows: 1. Tract "A" in Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska shall not be sub- ject to this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND COVENANTS FOR SUMMERFIELD ESTATES FIRST SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA except as contained in this Article III., Paragraph 1. The only restrictive cove- nants, restrictions and conditions as to Tract "A" in Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska are as follows: a. If any building or structure is constructed on Tract "A", the owner of such building or structure on Tract "A ", shall construct and maintain a wall ap- proximately six (6) feet in height constructed of a ma- son material of brick or block as a barrier between the building or structure on Tract "A" and the residential lots adjacent to the north of Tract "A" consisting of Lots Four (4) through Eight (8), Block Two (2) in Summerfield Estates First Subdivision in the City of Grand Island, Hall County, Nebraska; and b. Prior to the initial construction of the wall described in Article III. Paragraph 1.(a) hereof, the owner of such building or structure on Tract "A" shall obtain the preapproval of materials to be used in con- structing the wall described in Article III. Paragraph 1.(a) hereof by Owner, which preapproval shall not be unreasonably withheld by Owner. 2. All lots in the subdivision shall be known and de- scribed as residential lots with the exception of Tract A.
