200003380 <br />(b) All water and water rights, whether appropriated or not, and whether <br />adjudicated or not, including, tributary, non - tributary, surface, <br />underground, spring and seep waters, ditches and ditch rights, <br />reservoirs and reservoir rights, water wells and well rights, storage <br />rights, storage tanks, pumps and water lines, well permits and related <br />well equipment used on or in connection with the Mortgaged <br />Property, and all mineral rights and royalties, in each case owned by <br />Grantor, if any, together with all appurtenances thereto; <br />(c) All rights, rights of way, rights with respect to railroad spurs and <br />railroad tracks, easements, licenses, profits, privileges, tenements, <br />hereditaments, and appurtenances now or hereafter in any way <br />appertaining to and belonging to or used in connection with the <br />Mortgaged Property or the Improvements and a part thereof or as a <br />means of access thereto, including but not limited to any claim at law <br />or in equity and any after acquired title and reversion in or to each <br />and every part of all streets, roads, highWays, alleys and common <br />areas adjacent to and adjoining the Mortgaged Property; <br />(d) All deposits made with or other security given to utility companies by <br />Mortgagor with respect to the Mortgaged Property and Improvements <br />and all advance payments of insurance premiums made by <br />Mortgagor with respect thereto and claims or demands relating to <br />insurance; <br />(e) All rights in and to any and all leases (including, without limitation, the <br />"Permitted Leases" as described in Section 2.7 of this Mortgage) <br />with respect to the Mortgaged Property or the Improvements or any <br />part thereof and all rentals, earnings, income, deposits, security <br />deposits, receipts, royalties, revenues, issues and profits, whether <br />received directly or indirectly, which, after the date hereof, and while <br />any portion of the indebtedness secured hereby remains unpaid, may <br />accrue from or be attributable in any way to the leasing of the <br />Mortgaged Property and /or the Improvements or any part thereof; <br />(f) All damages, royalties and rentals and revenues of every kind, nature <br />and description whatsoever that Mortgagor may be entitled to receive <br />from any person, company or corporation owning or having or <br />hereafter acquiring a right to the oil, gas or mineral or water rights in <br />the Mortgaged Property or any part thereof with the right in <br />Mortgagee to receive and receipt therefor and apply and release <br />such monies received by it in the same manner and with the same <br />effect as provided herein for disposition of proceeds of fire or other <br />2000 MORTGAGE <br />(Grand Island, Nebraska) <br />12 <br />
