200003380 <br />b. Promissory notes of Mortgagor to and in favor of John Hancock Variable Life <br />Insurance Company in the aggregate original principal amount of $1,500,000, <br />c. Promissory notes of Mortgagor to and in favor of Investors Partner Life <br />Insurance Company in the aggregate original principal amount of $1,000,000; <br />d. Promissory notes of Mortgagor to and in favor of Barnett & Co. in the aggregate <br />original principal amount of $4,000,000; and <br />e. Promissory notes of Mortgagor to and in favor of Hare & Co. in the aggregate <br />original principal amount of $2,500,000. <br />NOW, THEREFORE, pursuant to the terms of the 2000 Note Purchase Agreement, <br />the terms of which are hereby incorporated in this Mortgage as if fully set forth herein, <br />Mortgagor hereby agrees as follows: <br />GRANTS MADE AND OBLIGATIONS SECURED. 1#1 <br />A. Grants. <br />Section 1.1 Mortgagor, in consideration of sums loaned by Mortgagee, received by <br />Mortgagor, and evidenced by the 2000 Notes, each with a maturity date as <br />set forth above, and each bearing interest thereon in accordance with their <br />respective terms, and for other good and valuable consideration, does by <br />these presents sell, convey, grant a security interest in, assign, pledge and <br />mortgage unto said Mortgagee all right, title and interest of Mortgagor, now <br />owned or hereafter acquired, in and to the Mortgaged Property, together <br />with all right, title and interest of Mortgagor, now or hereafter acquired, in <br />and to: <br />(a) All improvements of every kind and description now or at any time <br />hereafter located on the Mortgaged Property (the "Improvements "), <br />including all buildings, structures, storage facilities, equipment, <br />machinery, apparatus, fixtures, fittings and any additions to, <br />substitutions for, changes in or replacements of the whole or any part <br />thereof, now or at any time hereafter affixed to, attached to, placed <br />upon or used in any way in connection with the use, enjoyment, <br />occupancy or operation of the Mortgaged Property or any portion <br />thereof, including but not limited to any items of such property as may <br />be described in Exhibit "B" hereto attached and by such reference <br />made a part hereof, and owned by the Mortgagor or in which <br />Mortgagor now or hereafter acquires any interest and all renewals or <br />replacements or substitutions for any of the foregoing described types <br />or items of property; <br />2000 MORTGAGE <br />(Grand Island, Nebraska) <br />3 <br />
