200003380 <br />insurance; and Mortgagee may demand, sue for and recover any <br />such payment but shall not be required to do so; <br />(g) All existing and hereafter acquired machinery and equipment <br />necessary or useful in connection with the operation of a refrigerated <br />warehouse facility on the Mortgaged Property, such as chillers, <br />compressors, evaporators, racks, and any and all related piping and <br />mechanical equipment, and all other tangible personal property <br />located on the Mortgaged Property or, wherever located, now owned <br />or hereafter acquired by Mortgagor and used or held for use in <br />connection with the use, operation or occupancy of the Mortgaged <br />Property and the Improvements, including, but not limited to, any <br />such item included in the Improvements and any items described on <br />Exhibit "B" hereto attached which could be characterized as personal <br />property and all building materials, supplies, machinery and <br />equipment now or hereafter delivered to the Mortgaged Property and <br />the Improvements and installed or used or intended to be installed or <br />used therein; and all renewals or placements thereof or <br />substitutions therefor; <br />(h) Those general intangibles necessary or essential to the ownership, <br />operation, management and use of the Mortgaged Property or the <br />Improvements, including, but not limited to, any plant design or <br />engineering rights; all permits, approvals, consents, clearances, <br />licenses and rights obtained from any governmental agency with <br />respect to the Mortgaged Property or the Improvements, <br />(i) All leasing, service, engineering, consulting, construction, purchase <br />and other contracts of any nature necessary for or essential to the <br />ownership, operation, management or use of the Mortgaged Property <br />or the Improvements, as such may be modified, amended or <br />supplemented from time to time; <br />(h) All payment and performance bonds or guarantees and any and all <br />modifications and extensions thereof relating to the Mortgaged <br />Property or the Improvements; <br />(i) All reserves, deferred payments, deposits, rebates, refunds, cost <br />savings and payments of any kind necessary for or essential to the <br />ownership, operation, management, occupancy, use or disposition of <br />any portion of or all of the Mortgaged Property or the Improvements; <br />(j) All proceeds and claims arising on account of any damage to or <br />taking of the Mortgaged Property or the Improvements or any part <br />thereof and all causes of action and recoveries for any loss or <br />2000 MORTGAGE <br />(Grand Island, Nebraska) <br />5 <br />
