<br /> Subsequent Taxes. !f any tax to which this secti�n applies is enacted su�sequent �o the date vf this Deed af
<br /> Trus�, th�s e�enf shalf ha�e th� same effect as an Event of Default, and Lender may exercise any or al[ ofi its
<br /> a�ailabfe remedies �or an Even� of Defaul� as pro�ided belorrv unl�ss Trustar either �'I} pays �he tax be�ore it
<br /> becomes delinquent, or (2} con#es�s the tax as prc��ided abo�e in the Taxes and Liens section and deposits wifh
<br /> L�nde�-cash o�a sufficient corporate surety bond vr o�her security sa�is�actory�o L�nder.
<br /> SECURiTY AGREEiV�ENT; FINANCING STATENfENTS. The foilow�ng pro�isions relating to this Deed of Trust as a
<br /> security agreement are a part of th�s Deed vf Trust;
<br /> 5ecurity Agreement. This instrument shal! c�nstitu�e a Se�uri�y Agreement to the extent any of #h� Property
<br /> cans�itutes fixtures, and Lende�-shall ha�e aIl of�he rights��'a secur�d party under fhe Uni�arm �ommercial Cade

<br /> Security �nterest. Upon request by Lender, Trustor shall take whate�er action is requested by Lender to perFect
<br /> and cQntinue Lender's security in�erest �n the Ren�s and Personal Property. In add�tion to record�ng this C]eed af
<br /> Trust in the real proper�y records, Lender may, at any time and withou� fiur�her authorization ��om Trustar, fi�e
<br /> executed counterpa�ts, copies or reproductivns o�' this Deed af Trust as a financing statement. Trustor shall
<br /> reimburse Lender for all expenses incurred in perfec#ing or continuing this s�curity interest. Upon default, Trusta�
<br /> shall nvt �emo�e, seWer or detach the Personal Property from the Property. Llpon defaui�, Trustar shail assemble
<br /> any Personal Property nat affixed to�he Proper�y in a manner and at a place reasonab�y can�enienf t❑Trustvr and
<br /> Lender and make it a�ailah�e to Lender within three �3} days after r�ceipt of written demand from Lender t❑ the
<br /> extent perm€�ted by appficabfe Iaw.
<br /> Addresses. The mail�ng addresses af Trus�or �debtvr� and Lender �secur�d party} from whieh infarmation
<br /> con�erning the se�urity interest granted by this Deed of Trust may be obtained �each as requ+red by the uniform
<br /> Commercial Code}are as stated an the frst page o�'this Deed o�Trust.
<br /> FURTHER ASSURANCES; ATTQRNEY-�N-FACT, The foflawing pra�isions relating �o further assurances and
<br /> at�orney-in��act are a part of this Deed o�T�ust:
<br /> Fur�h�r Assurances. At any time, and from �ime to time, upon request of�.ender, Trustar wiil make, execute and
<br /> deii�er, or wi�l cause�a be made,executed or deli�ered, tQ Lendgr ar to Lend��'s designee, and when �equested by
<br /> Lender, cause ta be filed, recorded, refled, or�erec�rded, as the case may ae, at such times and in su�h o�fces
<br /> and places as Lender may deem appropriate, any and a�i such mor�gag�s, deeds of trust, security�eeds, security
<br /> agreements, financing sfa#ements, canfinuatian statements, insfruments of fu�ther assurance, certificates, and
<br /> oth�r documen�s as may, in th�svfe apinion of L�nder, be necessary Qr desirable in or�er ta effectuate, complet�,
<br /> pe�fect, continu�, or� pr�se�ve �1� Borrower's and Trustor`s obl�gafions unde�tne Nflte, th�s Deed of Trus�, and
<br /> #he Related Documents, and �2} the �iens and secur��y int�res�s�r�ated by this Deed af Trust as first and prior
<br /> liens on �he Praperty, whether now owned ar hereafter acquired by Trus�or. Unless prahibited by �aw or Lender
<br /> agrees to the �ontrary in wri�ing, Trust�r shall reimburse Lender for all casts and expenses incu�red in connection
<br /> with the mat�ers referred t�in this pa�-agraph.
<br /> Attorney-in�Fact. I�Trustor fai�s to do any flf the�hings referred ta in the pre�eding paragraph, Lender may do so
<br /> far and in the name of Trustar and at Trustor's expense. Far such purposes, Trustor hereby i�revocably appoin�s
<br /> Lend�r as Trustor's atto�ney-in-�'act for the purpase af making,executing, de�i��ring, filing, recording, and�oing a�!
<br /> o#her�hings as may be necessary or desirable, �n L�nder's so�� opin�on, �� accomplish the matters referred to in
<br /> the preceding parag�aph.
<br /> FULL PERFQRMANCE. !f Borrower and Trustor pay afl the lndebtedness when due, and Trustor o#herwise performs a�l
<br /> the obl�gatians imposed upon Trustflr under�h�s Deed of Trust, Lender shall execute and de�iver to Trus�ee a�equest�or
<br /> �u�l recon�eyance and shall execute and deli�er to Trustor suitable statemen#s❑�termination n�any financing statement
<br /> on file e�idencing Lender's security interest in the Rents and �he Personal Praperty. Any�-econ�eyance fee �-equired by
<br /> !aw shall be paid by Trust�r, if perm�tted by appiicabie law.
<br /> EVENTS �F DEFAULT. Each af the �oiiowing, at Lender's option, shail constitute an E�ent of De�Fau[�unde�this Deed
<br /> of Trust:
<br /> Payment Defaulf. Borrawer fails to make any payment when due under the indebtedness.
<br /> Dther Qefaults, garrower �r Trus�or fails to comply with or ta per�orm any other term, obl'rgation, co�enant or
<br /> ��n�ition contained in this I]eed of Trust o�- in any of the Related Dacuments❑r to comply wi�h or to perform any
<br /> term,obligat�on,co�enant or cond�tion c�ntained in any other agreement between Lender and Bvrrower❑r Trustor.
<br /> ��mp�iance D�faul#. Fa��ure to camply w�tn any other term, obligatian, co�enant or condi�ion contained in �his
<br /> Deed of Trust,the Note or in any af the Rela�ed Documents. � �
<br /> Default on�ther Pa�ments. Failure of Trustor w�thin the�ime requir�d by this Deed o�Trus�to make any payment
