2� 15�8�57 <br /> Se�tion 2.3 - Insurance, Dama�e and Destru,ction. The Trustor shall, at its sole expense, <br /> �b�ain for, del�ver to and mainta�n for the benefit af th� Beneficiary during the �erm of this Deed of <br /> Trust, such insurance co�erage as is set for�h an Exhibit B attached here�o,and such o�her insurance as <br /> Benefic�ary may reasonably requ�re. � <br /> The Trustor shall pay promptly,or cause to be paid promptly,when due,the premiums of suCh <br /> insurance policies and any renewals th�reof. The form and substanCe of such policies and the <br /> companies issuing them shall be acceptable to the Beneficiary. <br /> Trus�or hereby assigns ta the Beneficiary, as further securi�y, all unearned premiums an any <br /> �nsurance policies and renewals described in this D�ed af Trust. In the e�en�of the foreelosure af this <br /> L7eed of Trust or any other transfer of title to the Mortgaged Property in extinguishment of the Secured <br /> Indebtedness and other sums secured hereby, a�l right, ti��e and �nterest of the Trustor in and t� all <br /> insurance palicies and renevvals�hereof then�n force shall pass�o�he purchaser or grantee. <br /> In case of lass cfl�ered by policies of insuranc�, the Trustor may take such action as it may <br /> reasonably and in goad faith deem appropriate t❑ adjust and colle�t for any Iosses so Iong as: (i} <br /> Trustar is, in the reasonable opini�n of the Bene�ciary, diligently pursuing the adjustmen� and <br /> collection of any such insurance and, �ii} the loss must b� set�led and ad�usted, or litigation must ha�e <br /> b�en commenced with respect tio the Ioss, within eigh�een �1 S} months of the loss; otherwis� th� <br /> Beneficiary�whether before or after the forec�osure sale� shall be auth�rized at its option and wi�hflut <br /> the cnnsent of Trustor ta se�tle and adjust any c�aim arising out of such policies and collect and receip� <br /> for the pr�ceeds payable therefrorn. Any expense incurred by the Beneficiary in the adjustment and <br /> callectian af insurance proceeds {including vvi�hout limitation the cost of any independ�nt appraisal of <br /> the loss or damage on behalf of B�neficiary} sha�l be reimbursed to �he Beneficiary first �ut of any <br /> proceeds. Sub�ect to the conditions in the follow�ng paragraphs, if no uncured E�ent of Default �hen <br /> ex�sts, the net proceeds a�ailable following damag�or destruction of the Mortgaged Property shall be <br /> used to restore and r�pair the Mor�gaged Froperty if such proceeds are sufficien� to do so. If such <br /> proceeds are insufficient to restore or repair the Mortgaged Property to its condition priar to the lass, <br /> reasonable wear and tear excepted,or an uncured E�ent vf Default exists or if the Trus�or is unable to <br /> satisfy �he canditi�ns in the following paragraphs, the proceeds shall be used to pr�pay the Secured <br /> Indebtedness. <br /> The Trus�flr sha11 have the right, exercisab�e by written notice�o Beneficiary within s�xty�64� <br /> days aft�r the occurrence af a loss described above, to apply the net proee�ds of any�nsurance award <br /> to repair, restore, or replace the Mortgag�d Property to its condition immediately prior to said loss; <br /> provided�hat in the opinion of Ben�ficiary a�l af the following conditions have been met: <br /> A. There are sufficient praceeds availab�e ta c�mplete the repair, restoration, or <br /> replacement. <br /> B. �f the work is structural or if th� cost of the work, es�imated by Beneficiary, sha�1 <br /> exceed �ne Hundred Thausand and Nfll l�� Dollars �$1�4,�4�.�4}, plans and <br /> specifications for such work will be prepared by a Iicensed architect satisfactory to <br /> Beneficiary, which plans and specif�ations will be subject to approval by <br /> Beneficiary and an inspecting architect acceptable ta Beneficiary and such <br /> � architeet shall certify that su�h repair, restoration or replaceme�at can be cornpleted <br /> at leas� six (�� manths prior t� the Maturity Date �as defined in �he Loan <br /> Agreement}. <br /> � <br />
