<br /> Taxes. The following shall c�nstitute taxes to which this secti�n app[ies: {1} a spec�fic tax upan �his �ype af
<br /> De�d of Trust or upon a�l or any part of the Indeb�edness secured by this Deed v�Trust; �2} a specific tax on
<br /> Trus�or which Trus�or�s authori�e� ar required ta deduct frvm paymen�s an the �ndebtedness secured �y�his type
<br /> of Deed af Trust; �3� a �ax on �his type of Deed Qt Trust chargeahle agains�the Lender vr the hold�r o�the N�te,
<br /> and 44� a specific �ax on all or any pQrtit�n tif the Indebtedness or on paymen�s of principal and interest made by
<br /> Trustor.
<br /> 5ubsequent Taxes, If any tax to which this section applies is enac�ed subsequ�nt #o the date af this Deed a�
<br /> Trust, �his even� shall ha�e �h� same e��ect as an EUen� of Default, and Lender may exercise any or aIl of its
<br /> aWa�labf� remedies for an Even� �f aefault as pravid�d below unless Trustor either {1} pays th� tax befare it
<br /> becom�s delinquen�, �r �2} cantests the tax as provided abo�e in the Taxes and Liens section and deposits with
<br /> Lender cash or a sufficient�orporate sure�ty�and or other security satis�factory to Lender.
<br /> SECUR�TY AGREEMENT: FINANCING STATEMENTS. The �oll�wing pro�isions r�lating to �his Deed ��F Trusfi as a
<br /> s��urity agreement are a part a�this D�ed of Trust:
<br /> Securi�y Agreement. This instrument shall �ons�itute a 5e�u�i�y Agreement to the extent any vf the Property
<br /> cans�itutes �fixtures, and Lender sha�! have all af the righ�s af a secured party under the Uni�orm Commercial Co�e
<br /> as amended from�ime ta�ime.
<br /> 5ecurity Interest. Upon request by Lender, Trustvr shail take whate�er ac�i�n is reques�ed by Lender t❑ perfect
<br /> and c�ntinue Lender's security interest in �he Personal Property. ln addi�ion t� recording this Deed of Trust �n the
<br /> real praperty r�Gords, Lender may, a� any time an� without �urther au�thori�ation from Trustor� �i�e sx�cu�ed
<br /> count�rpar�ts, capies ar reprodu�tions of this De�d of Trust as a financing s�atemen�. Trust�r shall reimburse
<br /> Lender �For all expenses [ncurred in pe�fecting �r continuing this se�uri�y in�erest. Upon default, Trust�r shall not
<br /> remo�e, se�er vr detach the PersonaE Proper�ty from the Property. Upon default, Trustar shall assemble any
<br /> Personal Property nat a�fixed to the Prvp�rty in a manner and a� a piace reasonably �onvenien�t t� Trustar and
<br /> Lender and make it a�ailab[e to Lender within three {3} days after receipt of writt�n demand fram L�nder to the
<br /> extent permit�ed by applicable law.
<br /> Addresses. The mailing addresses of Trusfiar {debtvr� and Lender �secured party� fir�m which infarmati�n
<br /> concernEng th� securi�y in�erest granted by �his Deed of Trust may he obtained �each as required by the Llnifarm
<br /> �ammer�ial Codey a�e as sta�ted �n�he#irst pag�of this Deed of Trust,
<br /> FUFtTHER ASSURANGES: ATT�RNEY-IN�FACT. The f��lowing pro�isions relating to further assurances and
<br /> attorney-in-fact are a part af this D�ed of Trust:
<br /> Furfiher Assurances. At any time, and fr�m time t� time, upon request vf Lender, Trustor wilf mak�, exe�u�e and
<br /> deliver, ar will cause to b� made, exe�uted ar d�livered, t� Lender or to Lender's designee, and when requested by
<br /> L�nder, cause tv be f�led, recorded, refiled, nr rerecorded, as the case may be, a� such tirnes and in su�h affices
<br /> and places as L�nder may deem appropriate, any and ali such mort�ages. deeds of trust, s�Gurity dee�s, security
<br /> agr�ements, financing stat�ments, cantinuation staternents, ins�ruments �f fur�her assurance, certi�icates, and
<br /> o�her dvcumen�s as may, in the sale opinion of L�nder, be ne�essary vr d�sirahle in order to �ffectua��, complete,
<br /> perfieGt, continue, or preser�e ��y Trus��r's obligations under the Note, this Deed of Trus�, and �he Relat�d
<br /> Dvcuments� and �2} the li�ns and securi�y interes�s created �y this Deed o�F Trust on fih� Proper�y� whether nvw
<br /> owned �r hereafter a�quired by Trustar. lJnless pr�hibited by iaw or Lender ag�ees to the con�rary in wri�ing,
<br /> Trustor shal� reimburse Lender for all costs and expenses incurred in �onne��ian with the matters refer�ed t� in this
<br /> paragraph,
<br /> Attorney-in�Fact. if Trustor fails ta d� any ❑f the things r�f�rred to in the preceding paragraph, Lender may d� so
<br /> �o� and in �h� name �f Trus�or and a� Trus�or's expens�. Far such purposes, Trust�r hereby irreWacably appoin�s
<br /> Lender as Trus�or's att�rney-in-fact for the purpose vfi rnaking, executing, deli�ering, �filing, recording, and doing all

<br /> FULL PERF�RiV1AN�E. lf Trus�ar pays at� the Indehtedness, inc�uding wi�hout lirni�a�ian all �uture ad�ances, when due.
<br /> and oth�rwise per�orms al� �he obfigations impased upon Trustor und�r this aeed o�F Trust, Lender shalf ex�cu�re and
<br /> deli�er to Trust�� a request for full recanveyan�� and sha[I execute and de�i�er ta Trustar sui�able statements vf
<br /> t�rminat��n af any financing stat�ment on #ile e�iden�ing Lend�r's security int�r�st in th� Ren�s and the Personal
<br /> Praperty. Any recanveyanc�fee required by law shall be pa�d by Trustor, �f permitted �y appl�cable law.
<br /> ❑EFAULT. At Lend�r's�ption,Trustor will be in default under this �3eed o�Trust if any of fihe fal�awing happen:
<br /> Fraud vr Nlaterial flllisrepresen�ativn. Trus��r commi�s fraud ar ma�erial misrepresentation in connecfiion with th�
<br /> t�rms of the Note.
<br /> Payrnent Defaulfi. Trustflr fails�a m�et the repayment terms of the Not�for any outstanding balance.
<br /> Dfiher De�aul�s. Trustar's act ❑r �Faiiure �o act ad�ersely af�ec�s Lender's securit}r interest in the Prap�rty, ❑r any
<br /> right ofi Lender's in such security.
