201502871 <br />Any assessment not paid within thirty (30) days after the due date of such assessment <br />shall bear interest at the maximum rate allowed by law. <br />The Association may bring an action at law against any Owner of any Lot contained <br />within the Properties in the same manner as provided by law for foreclosure of mortgages. <br />The lien for assessments provided hereinabove shall be subordinate to the lien of any first <br />mortgage and any first mortgagee may rely on this provision without execution of any further <br />subordination agreement by the Association. <br />No vacant Lot contained within the Properties shall be subject to an assessment hereunder <br />until buildings or improvements are constructed thereon and such buildings and improvements <br />are ready for occupancy. <br />Except as otherwise provided herein in regard to vacant Lots within the Properties, the <br />restrictive covenants, restrictions and conditions contained in this DECLARATION OF <br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD <br />ESTATES EIGHTH SUBDIVISION HOMEOWNERS' ASSOCIATION relating to <br />maintenance of the Lots within the Properties shall apply on the same basis to all Lots within the <br />Properties. <br />5. The assessment levied by the Association shall be used exclusively for the following <br />purposes: <br />a. Maintenance and care of center islands on Meadow Road, <br />maintenance and care of shrubs, vegetation, grass or landscaping within such <br />center islands and acquisition and maintenance of facilities and equipment <br />necessary to water the shrubs, vegetation, grass or landscaping within such center <br />islands or otherwise maintain such center islands; <br />b. Maintenance, repair and care of the north sign for Summerfield <br />Estates including, but not limited to, the payment of any premiums of insurance <br />on the north sign for Summerfield Estates; and <br />c. Payment of any electric bill for the north sign for Summerfield <br />Estates. <br />The Association is ''specifically authorized hereunder to contract with any third party to <br />manage the Properties or provide maintenance as provided herein. <br />In the event that any maintenance or repair is caused through the willful or negligent act <br />of any Owner, his or her family, guest or invitees, the cost of such maintenance shall be promptly <br />paid by such Owner. <br />4 <br />
