201502871 <br />through Seven (7), Block Three (3) all in Summerfield Estates Eighth Subdivision <br />in the City of Grand Island, Hall County, Nebraska. <br />d. "Lot" shall mean and refer to any platted lot of land upon the recorded <br />subdivision plat of the Properties and shall include only Lots One (1) through <br />Eleven (1 1), Block One (1), Lots One (1) through Nine (9), Block Two (2) and <br />Lots One (1) through Seven (7), Block Three (3) all in Summerfield Estates <br />Eighth Subdivision in the City of Grand Island, Hall County, Nebraska, such plat <br />being recorded in the Office of the Register of Deeds of Hall County, Nebraska. <br />3. Every Owner of a Lot within the Properties shall be a member of the Association. <br />Membership in the Association is a condition of ownership of any Lot within the Properties. <br />Membership shall be appurtenant to and may not be separated from ownership of any Lot which <br />is subject to assessment. The Association shall have one class of voting membership which shall <br />be and include the Owner of each Lot contained in the Properties. When more than one (1) <br />person holds an interest in any Lot contained within the Properties, all such persons shall be <br />members of the Association but any vote for such Lot shall be exercised as they among <br />themselves determine with no more than one (1) vote being cast with respect to any Lot. <br />4. Each Owner of any Lot contained within the Properties agrees to this <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />FOR SUMMERFIELD ESTATES EIGHTH SUBDIVISION HOMEOWNERS' ASSOCIATION <br />by acceptance of any conveyance of, whether or not it is so expressed in any such conveyance, <br />and is deemed to covenant and agree to pay to the Association regular annual maintenance <br />assessments or charges for the purposes set forth in Article III., Paragraph 5. hereof. <br />Such regular assessments, together with interest, costs and reasonable attorneys' fees <br />shall be and constitute, from the date levied until paid, a lien upon such Lot against which such <br />assessment is made, without any requirement of recording further notice of such lien. <br />Such regular assessments, together with interest, costs and reasonable attorneys' fees <br />shall also be the personal obligation of each person who was an Owner of such Lot against which <br />such assessment is made at the time when such assessment was due. <br />Except as otherwise provided herein in regard to vacant Lots within the Properties, all <br />regular assessments shall be determined at a uniform rate for all Lots contained within the <br />Properties and collected on a monthly basis. Except as otherwise provided herein in regard to <br />vacant Lots within the Properties, there shall be a pro rata mandatory assessment at least once a <br />year on all Lots within the Properties for the purposes set forth in Article III., Paragraph 5. <br />hereof. <br />The Association shall fix the amount of any annual assessment in advance of each annual <br />meeting of the Association. The monthly due dates for payment of assessments shall be <br />determined by the Association. <br />3 <br />
