<br />ESTATES EIGHTH SUBDIVISION HOMEOWNERS' ASSOCIATION are a fee simple
<br />interest in Lots One (1) through Eleven (11), Block One (1), Lots One (1) through Nine (9),
<br />Block Two (2) and Lots One (1) through Seven (7), Block Three (3) all in Summerfield Estates
<br />Eighth Subdivision in the City of Grand Island, Hall County, Nebraska. The lands submitted to
<br />this DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND
<br />CONDITIONS FOR SUMMERFIELD ESTATES EIGHTH SUBDIVISION HOMEOWNERS'
<br />ASSOCIATION, are Lots One (1) through Eleven (11), Block One (1), Lots One (1) through
<br />Nine (9), Block Two (2) and Lots One (1) through Seven (7), Block Three (3) all in Summerfield
<br />Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska.
<br />RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS
<br />In consideration of the mutual benefits to be derived by the Owner of and any purchaser
<br />or purchasers, their heirs, devisees, personal representatives, successors, assigns or grantees, the
<br />Owner stipulates and agrees that all of Lots One (1) through Eleven (11), Block One (1), Lots
<br />One (1) through Nine (9), Block Two (2) and Lots One (1) through Seven (7), Block Three (3) all
<br />in Summerfield Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska,
<br />that are sold, transferred or conveyed, shall be and are subject to the following restrictive
<br />covenants, restrictions and conditions except as provided herein. All restrictive covenants,
<br />restrictions and conditions shall run with the land and are as follows:
<br />1. This DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND
<br />CONDITIONS FOR SUMMERFIELD ESTATES EIGHTH SUBDIVISION HOMEOWNERS'
<br />ASSOCIATION shall apply to Lots One (1) through Eleven (11), Block One (1), Lots One (1)
<br />through Nine (9), Block Two (2) and Lots One (1) through Seven (7), Block Three (3) all in
<br />Summerfield Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska.
<br />2. The following definitions shall apply to this DECLARATION OF RESTRICTIVE
<br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES
<br />EIGHTH SUBDIVISIONS HOMEOWNERS' ASSOCIATION:
<br />a. "Association" shall mean the homeowners' association to be formed by
<br />the Owner to be known under the name of " Summerfield Estates Eighth
<br />Subdivision Homeowners' Association" or such other name as selected by Owner
<br />and its successors and assigns.
<br />b. "Owner" shall mean an owner of Lots One (1) through Eleven (11),
<br />Block One (1), Lots One (1) through Nine (9), Block Two (2) and Lots One (1)
<br />through Seven (7), Block Three (3) all in Summerfield Estates Eighth Subdivision
<br />in the City of Grand Island, Hall County, Nebraska.
<br />c. "Properties" shall mean and refer to Lots One (1) through Eleven (11),
<br />Block One (1), Lots One (1) through Nine (9), Block Two (2) and Lots One (1)
