<br /> �a} Any such agreements will not affect the amounts that Borrower has agreed to pay for Mortgag�
<br /> Insurance, or any other terms of the Lnan. Such agreements will nat incr�ase the arnount
<br /> Borrower wiil owe for Mortgage Insurance, and they will not entitle Borrower to any refund.
<br /> �b� Any such agreements will not affect the rights Borrower has - if any - with respect ta the
<br /> Mortgage Insurance under the Homeowners Protection Act of �998 ar any other 1aw. These rights
<br /> may include the ri�ht to receive certain disclosures, to request and obtain canceliation of the
<br /> Mortgage Insurance, to have the Mortgage Insurance terminated autamatically, andJor ta recei�e
<br /> a refund of any Mortgage Insurance premiums that were unearned at the time of such
<br /> cancellation or termination.
<br /> 11. Assignment of Miscellaneaus Proceeds; F�rfeiture. All Miscellan�ous Proceeds are hereby assigned to
<br /> and shall be paid to Lender,
<br /> If th� Property is damaged, such Miscellaneous Proceeds shall be applied to restorat�on or repair of the
<br /> Property, if the restoration or repair is economically feasible and Lender's security is not lessen�d. I�uring
<br /> such repair and restoratian period, Lender shall haWe the right to hold such Miscellaneous Proceeds until
<br /> Lender has had an opportunity to inspect such Property to ensure the work has been completed to Lender's
<br /> satisfactian, pro�ided that such inspection sha�1 be under�aken promptiy. Lender may pay for the repairs and
<br /> restoration in a single disburs�ment or in a series of progress payments as the work is completed. Unless an
<br /> abreement is made in writing ar App�icable Law requires interest to be paid on such Miscellaneous Praceeds,
<br /> Lender shall not be required to pay Barrow�r any interest or�arnings on such Miscellaneous Proceeds. �f�he
<br /> restoration or repair is not ecanomically feasible or Lender's security would �e lessened, the Misce�laneous
<br /> Proceeds shall be applied to the sums secured by this Security Instrument, whether ar not then due, with the
<br /> excess, if any, paid to Barrower. Such Miscellaneous Proceeds shall be appl�ed in the order provided for in
<br /> Section 2.
<br /> �n the e�ent of a total taking, destruction, or loss in �a1ue of the Property, the Miscellaneous Proceeds sha11
<br /> he applied to the sums secured by this S�curity �nstrument, whether or not then due, with the excess, if any,
<br /> pa�d to Borrower.
<br /> In th� e�ent of a partial taking, destruction, or loss in �a1ue of the Property in which the fair mark�t�alue of
<br /> th�Property immediately before the partial taking, destruction, or loss in �alue is equal to or greater�han the
<br /> amount of�he sums secur�d by this Securi�y Instrument imm�diately before the partial taking, destruction, or
<br /> loss in �a1ue, unless Borrower and L�nder o�h�rwise agree in writing, �he sums secured by this Security
<br /> Instrum�nt shall be reduced by the amount of �h� Miscel�aneous Proceeds mul�iplied by the following
<br /> fraction: �a} the total amount of the sums s�cured imm�diately before the partial taking, destruction, or loss
<br /> lIl �alue di�ided by �b} the fair mark�t �alue of the Property immediately befor� the partial �aking,
<br /> destructian, or loss in�alue. Any balance shall he paid to Borrower.
<br /> In the e�ent of a partia�taking, destruction, ar loss in value of the Property in which the fair marl�et�alue of
<br /> the Property immediately befnre the partial taking, destruction, or loss in �alue is less than the amount of the
<br /> sums secured immed�ately b�fore the partial taking, destruction, or loss in �alue, unless B orrawer and
<br /> Lender otherwise agre�in writing, the Miscellaneous Praceeds shall Ue applied to the sums secured by this
<br /> Security Instrument whether or not the sums are then due.
<br /> If the Praperty is abandaned by Borrower, or if, after notice by Lender to Borrower that the�pposing Party
<br /> �as defined in th� next sentence} offers to make an award ta settle a claim for damages, Borrower fails to
<br /> respond to Lender within 3U days after the date the natice i� gi�en, Lender is authorized tn collect and apply
