200000132 : <br /> values of the Property and, as required, to qualify the Property for <br /> use of Surface Transportation Program funds under terms of a covenant <br /> as evidenced by the Preservation Covenant dated the /��- day of <br /> , 1999, attached hereto, identified as Exhibit "B" and <br /> ereby made a part of this Historic Preservation Easement. The terms <br /> and conditions under which this grant is made are as follows: <br /> l. Grant of Easement. This easement granted herein, to be of <br /> the nature and character hereinafter further expressed, shall : <br /> constitute a binding servitude upon said Premises of the Grantor, and <br /> to that end Grantor covenants on behalf of himself, his successors and <br /> assigns, with Grantee, its successors and assigns, such covenants <br /> being deemed to run as a binding servitude, in perpetuity, with the <br /> land, to do (and refrain from doing) upon the premises each of the <br /> following stipulations, which contribute to the public purpose in that <br /> they aid significantly in the preservation of the historic property: : <br /> (a) The exterior surfaces of improvements (including, : <br /> without limitation, the exterior walls, roofs and chimneys) on : <br /> the subject Premises are those depicted in the photographs : <br /> attached hereto and incorporated herein as Exhibit A being : <br /> essentially those exterior surfaces of improvements on the <br /> aforesaid premises which are visible from North Plum Street, but <br /> in the event of uncertainty the exterior surfaces of improvements : <br /> visible in the photographs in Exhibit A shall control. Without <br /> the express written permission of the Grantee, its successors or <br /> assigns, signed by a duly authorized representative thereof, no <br /> construction, alteration, or remodeling or any other thing shall <br /> be undertaken or permitted to be undertaken on the Premises which <br /> would affect either the exterior surfaces herein described, or <br /> increase the height, or alter the exterior facade (including, : <br /> without limitation, exterior walls, roofs and chimneys) or the : <br /> appearance of the buildings located thereon, insofar as they are <br /> depicted in the photographs attached hereto and incorporated <br /> herein as Exhibit "A" or which would adversely affect the <br /> structural soundness of the Premises, provided, however, that the <br /> reconstruction, repair, repainting or refinishing of presently : <br /> existing parts or elements of the lot and improvements subject to <br /> this Historic Preservation Easement, shall be permitted without <br /> the prior approval of Grantee, provided that such reconstruction, <br /> repair, repainting or refinishing is performed in a manner which <br /> will not alter the appearance of those elements of the building : <br /> subject to this easement as they are as of this date. Grantor, <br /> in cleaning or painting the exterior of the building on the <br /> Premises, agrees to obtain the prior written consent of Grantee, <br /> its successors or assigns, signed by a duly authorized <br /> Page 2 of 9 : <br />
