2 � 0 � 00132 <br /> HISTORIC PRESERVATION EASEMENT <br /> THIS GRA�1T OF AN HISTORIC PRESERVATION EASEMENT is made this <br /> %l��day of � , 1999, by the HALL COUNTY HISTORICAL <br /> SOCIETY, a Nebraska Corporation, ("Grantor" herein) and HALL COUNTY <br /> STATE OF NEBRASRA, a Municipal Corporation, ("Grantee" herein) . � <br /> W I T N E S S E T H <br /> WHEREAS, Grantor is the owner in fee simple of the historic <br /> Burlington Depot Building, located at 603 North Plum Street, in the <br /> City of Grand Island, State of Nebraska, as more fully described in <br /> Exhibit "A" attached hereto and incorporated by this reference herein <br /> (the "Property" herein) ; and <br /> WHEREAS, Grantor is the owner of the unused development rights in <br /> the Property; and <br /> WHEREAS, the Property has substantial and important historic, : <br /> aesthetic, architectural, scenic and cultural character and is <br /> eligible for listing on the National Register of Historic Places; and <br /> WHEREAS, the Grantor desires to preserve and maintain the <br /> historic, architectural and cultural character of the Property, and <br /> the Grantee is authorized by Nebraska Law to accept easements and <br /> other grants of rights in property, in order to preserve and maintain <br /> the historic, architectural, cultural and scenic character of such <br /> property; and <br /> WHEREAS, the Revised Statutes of Nebraska [and the Internal <br /> Revenue Code of 1986] do acknowledge or otherwise authorize easements <br /> for such purposes as heretofore stated, and <br /> WHEREAS, the Property is a historic transportation facility which <br /> has been designated as being eligible for the Enhancement Program <br /> portion of the Surface Transportation Program funds by the Department <br /> of Transportation, Federal Highway Administration; and <br /> WHEREAS, Surface Transportation Program funds have been or will <br /> be made available for interior and exterior rehabilitation of the <br /> Burlington Depot pursuant to Project No. STPB-40 (47) , State Control <br /> No. 42111, through Hall County and the State of Nebraska, Department <br /> of Roads; <br /> NOW THEREFORE, in recognition of the foregoing, Grantor hereby <br /> grants to Grantee (i) an Easement in the Property and (ii) all unused <br /> development rights in the Property (jointly referred to as a "Historic <br /> Preservation Easement") .
