The Master Tenant �hall ensure that the Healthcare <br /> Facility is at all times operated in accordance with the requirements of the <br /> Permits and Appr�va�s, and that none of the P�rmits and Approvals is <br /> plac�d at risk �f 5U5�]�riS��ri, revocation, rescission, term�nat�an or <br /> limitation, as evidenced by, without Iimitation, any cammunicatian from <br /> regu�atory or funding entities sa indicat�ng, <br /> 3. ��NDITI�N �F M�RTGA�ED PR�PERTY. <br /> �a} Master Tenant shall ma�nta�n, or cause to be maintained, �n dec�nt, safe, <br /> and sanitary cond�tion and good r�pair the Healthcare Facility and any <br /> other parts of the Proj e�t for which the Master Tenant is responsible for <br /> maintaining pursuant to the Master Lease. <br /> �b� Master Tenant shall nnt remodel, rec�nstruct, add to, or demolish, with�ut <br /> the prior written ��nsent of HUD, any part of the Proj ect ar subtract from <br /> any real or personal property of the Proj ect, except in the �rdinary caurse <br /> . <br /> o usiness. <br /> tc} Master Tenant shall not use �ar allow the �perator ta use} any partion of <br /> the Pr�j ect for any purpose except the Approved Use. <br /> �d} T� the extent of the authority �t has retained under the Barrower-�perator <br /> Agreem�nt, Master Tenant shall permit HUD andlor Lender t� conduct a <br /> physical inspection of the Hea�thcaxe Faci�ity at any reasonable time up�n <br /> reasonable notice. <br /> 4. RISI�MANA�`iEMENT PR�CrRAM. <br /> In accordance w�th Pr�gram �bligations, Master Tenant shal� implement and <br /> maintain, or cause [�perator to implement and maintain, a risk management <br /> program which incarporates a rea�-time incident reporting arid tracking system <br /> that informs �perator's and Mast�r Tenant's senior management of all incidents <br /> with the potent�al ta expose the �perator ta liahility for personal inj ury or other <br /> damages. Each in�ident must be reviewed by �perat�r's appropriateiy-trained <br /> professional staff, and such staff mu�t foilow-up on incidents as necessary. The <br /> risk management program must include appropriate training for�perator's staff. <br /> 5. N�TI�E �F VI�LATI�N AND EVENT �F DEFAULT. <br /> �a� Upon any violation �f any provision of this Agreement by Master Tenar�t, <br /> HLJD may give Written notice thereof to Master Tenant, with a copy to <br /> Borrawer and Lender.
