N�N-DISCRIMINATIC�N. <br /> There shall be full compl�ance with the provisions of �i} a.ny state or local laws <br /> pr�hibiting discriminativn in housing on the basis of race, color, creed, or national <br /> origin; and �ii� the Regulations af the Federai H�using Administration providing <br /> for non-discrimination and equal �p�]��Llrilty lIl �1�LI51ri�. It is understaod and <br /> agreed that failure or refusal to compiy with any such pro�isior�s shall be a proper <br /> basis for HUD to take any c�rre�tive action it may deem necessary including, but <br /> not limited to, th� refusal to cansent to a further renewal of the Master Lease <br /> betwe�n the Borrower and the Master Tenant, the rej e�tion of applicati�ns for <br /> FHA mortgage insurance and the refusal to enter int� future contracts vf any k�r�d <br /> with which Master Tenant is affliated; and further, if Master Tenant is a <br /> corporation or any vther type of business association or organization which may <br /> fail �r refuse to c�mp�y With the aforementioned pr�visions, HUD shall have a <br /> similar ri ht of correcti�e acti�n �i} with respect to any individuals wha are <br /> � <br /> . <br /> off cers, directars, trustees, managers, partners, assaciates or princlpa <br /> shareholders of Master Tenant; and �ii} with re�pect t� any other type of business <br /> association, or organization with wh��h the officers, directors, trustee, managers, <br /> partners, assoCiates or principal stockholders of Master Tenant may be identified. <br /> 14. B��KS, AC�[]UNTS, AND FINANCIAL REP�RTS. <br /> �a} Mast�r Tenant sha�l keep3 or shall cause to be kept, the books and <br /> a�counts �f the aperation of the Healthcare Facility in accordance with <br /> Program �bligat�ons, to the extent not �n�onsistent with state <br /> requirements, which would all�w for the audit of the Project. <br /> �b} Except as atherwise appro�ed by HUD, Master Tenant must deposit, or <br /> cause ta be �eposited, all rev�nue generated ar otherw�se re�e�ved in <br /> cor�nect�an with the Healthcare Fac�l�ty, in an operating accvunt, for the <br /> benefit af the Proj e�t, or in a general collection ac�ount maintained for <br /> �perat�r and affi�iated operators, provided deposits ta such general <br /> co�le�tian account can be traced to the applicable facility that generated <br /> such deposit. If HUI] determines that such de�osits cannot be reliably and <br /> readily so tra�ed, HUD may direct the Master Tenant to d�posit such <br /> funds in a segregated operating account. Additionally, HiJD may dire�t <br /> that any general coilect�on accnunt include funds �nly from facilities <br /> having FHA-1ri5Ll.Y'�[� ��a.I�S and encompassed within the Master Lease. <br /> The acc�unt must be with a financial institutivn vvhose deposits are <br /> P�evious�ersions obsvlete Page'ID of'14 form HUD-9�337-�RCF �Re�.�31�3} <br />
