PR�HIBITI�N �F �ERTAIN FEES. Master Tenant sha11 n�t charge and sha�i not permit �perator to charge, any resident of the Healthcare Fa�i�ity an admiss�on fee, key fee, finders' fee, cantinuing �are retirement community fee, l�fe-�axe fee or s�milar fee pursuant t� any agreement to furnish r�sidential units or services t� pers�ns making such payments. 9. SE�URITY DEP�SITS ANI] �THER FEES. Master Tenar�t sha�l nat require as a condition af occupancy or�eas�ng �f any unit �n the Healthcar� Facility, any consideration or deposit, provided that Mast�r Tenant may require, or may cause �perator ta require, the prepayment of the first m�nth's rent plus a security dep�sit in an amount not in excess of one month's rent, to guarantee the performance af any tenant lease terms. Master Tenant may charge certain app�ication processing fees such as credit check or crim�nal background fees or pet dep�sits. 1�. SUBLEASES. Master Tenant shail not lease or sublease the Prnject or any part there�f without the prior written consent of HUD. 11. C�MMER�IAL �N�N-RESIDENTIAL� LEASES. No p�rtion of the Proj eCt shall be l�ased for any commer�ial purpose or use without receiving HiJD's prior written appraval as to terms, form and amaunt, except as perrnitted in the �perator's Regulat�ry Agreement. Master Tenant sha�� deliver an ex��uted copy of any commer�ial �ease to I�UD. 1�. AUDITS AND INSPE�TI�NS. All pvrtians of the Proj ect, including without limitat�on a�� Mortgaged Property and any ather equipment, buildings, plans, �ffi�es, apparatus, devices, books, c�ntra�ts, records, documents, and other papers relating to the �peration of the Health�are Facility shall at all times b� mainta.ined in reasonabie condition for praper audit a.nd subject tn examination and inspe�t��n at any reasonab�e time by HUD, the L�nder, ar the duly authorized agents of either.
