All costs of performan�e of Borrower's <br /> ohligations under any�&M Program shall be paid by Borrower, and Lender's out-of pocket <br /> c�sts incurred in conne�tion with the monitoring and review�f the�&M Program and <br /> Borrovver's performance shall be paid by Borrower upon demand by Lender. Any such out-of- <br /> pocket�osts of Lender which Borrower fails to pay promptiy shall became an additional part of <br /> the Indebtedness as provided in Section 13; pro�ided that so �ong as the Laan is insured by HUD, <br /> no advances made by Lender under this subsectian�e� shall become an additional part of the <br /> Indebtedness unless such ad�ances recei��the pr��r written approval of HUD and pro�ided <br /> further that unless approved by HUD, Lender shail ha�e no obligation to make any such <br /> ad�ances. <br /> (f} Barrower repr�sents and Warrants to Lend�r that, �x�ept as previously disclosed <br /> by Borrower to Lender in writing: <br /> �1� Borrower has nat at any time engaged in, caused or perm itted any <br /> Prohibited Activities or�onditi�ns; <br /> (2� to the best of Borrawer's knowledge after reasonable and di�igent inquiry, <br /> no Prahibited Activities or Conditions�xist or hav�existed; <br /> (3} the Mortgaged Property does n�t now�ontain any undergraund st�rage <br /> tanks, and,to the best af Borrower's knowledge after reasonable and <br /> diligent�nquiry,the Mortgaged Proper�y has not contained any <br /> underground storage tanks in the past. If there is an underground storage <br /> tank located on the Mortgaged Praperty that has been pre�iously disclosed <br /> by Barrower to Lend�r in writing,that tank complies with ail requirements <br /> nf Hazardous Material s Laws; <br /> �4� Borrower has complied w�th alI Hazardous Materials Laws, including a11 <br /> requirements for notification regarding r�leases of Hazardous Materials. <br /> �ithout limiting the generality af th� foregoing, Borrawer has obtained all <br /> Previous versions obsolete Page 35 af 4� fvrm HUD-94���-C]RCF�Re�.fl3113} <br />
