��14��133 petroleum products used in the operation and maintenarice of motor�ehic�es and matar-operated eyuipment from time ta time �acated on the Mortgaged Praperty's parking areas, so long as all nf th� foregoing are used, stored, handled,trar�sported and d�sposed of in compliance with Hazardous Mat�rials Laws. �d} Borrower shall take a11 commercially r�asonable actions (including the inclusian of appropriate pra�isions in any Leas�s executed after the date of this S�curity Instrument�to prevent its employees, agents, and contractars, and a�l residents and other occupant� from causing or permitting any Prohibited Act�vities or Conditions. Borrower shall not lease or.allow the sublease or use of all nr any por�ian of the Martgaged Praperty to any resident or sublessee f�r nonresidentia� use by any user that, in the�rdinary c�urse of its bus�ness, wouid cause or permit any Pr�hihited Activities or�onditians. (e} If an �&M Program has been established with respe�t to Ha.zardous Materials, B�rrower sha�l camply in a timely manner with, ar�d cause al� empioyees, agents, and contractors af Borrower and any other persans encompassed by th� �&M Program and present an the Mortgaged Proper�y to c�mply vvith the �&M Program. All costs of performan�e of Borrower's ohligations under any�&M Program shall be paid by Borrower, and Lender's out-of pocket c�sts incurred in conne�tion with the monitoring and review�f the�&M Program and Borrovver's performance shall be paid by Borrower upon demand by Lender. Any such out-of- pocket�osts of Lender which Borrower fails to pay promptiy shall became an additional part of the Indebtedness as provided in Section 13; pro�ided that so �ong as the Laan is insured by HUD, no advances made by Lender under this subsectian�e� shall become an additional part of the Indebtedness unless such ad�ances recei��the pr��r written approval of HUD and pro�ided further that unless approved by HUD, Lender shail ha�e no obligation to make any such ad�ances. (f} Barrower repr�sents and Warrants to Lend�r that, �x�ept as previously disclosed by Borrower to Lender in writing: �1� Borrower has nat at any time engaged in, caused or perm itted any Prohibited Activities or�onditi�ns; (2� to the best of Borrawer's knowledge after reasonable and di�igent inquiry, no Prahibited Activities or Conditions�xist or hav�existed; (3} the Mortgaged Property does n�t now�ontain any undergraund st�rage tanks, and,to the best af Borrower's knowledge after reasonable and diligent�nquiry,the Mortgaged Proper�y has not contained any underground storage tanks in the past.
