Hazardous Materials Laws include, but are not 1 irn ited to,the Comprehensi�e En�ironmental Response, �ompensation and Liahility Act, 4� U.S.C. Sectian 95��, et seq., the Resource Conser�ation and Reco�ery Act, 4Z U.S.�. Secti�n �9�1, et sQq.,the Toxic Substance �ontro� Act, 15 U.S.�. Section 26�1, et�seq.,the Clean Water Act, 33 U.S.C. Section �251,et seq., and the Hazardaus Materials Transportatian Act, 49 U.S.�. Section S 1�1, et seq., and their state analogs. (3} "Environmenta� Permit" means any permit, license, or other authorization issued under any Hazardous Material s Law with respect to any acti�ities or businesses conduct�d�n or in relation ta the Martgag�d Property. (b} E�cept for�1� matters covered by a Written program of operations and maintenance appro�ed in writing by Lender("�&M Program"�, (2}matters described in subsect�ar� (c} of this Section 4$; or(3} �for so long as the Loan is insured or held by HUD� matters co�ered by Program �bligations that may differ fr�m this Sect�on 48 (wi�h respect to lead based paint reauirements, for example}, Borrow�r shall not cause ar permit any of the fallowing: �i} any occurrence or conditian on the Mortgaged Property or any other property of Borrower that is adjacent to the Mor�gag�d Property,wh�ch occurren�� or conditian is�r may he in vialation of Hazardous Materials Laws; ar �11} any�iolation of or n�ncampliance with the terms of any En�iranmentai Permit with respect to the Mortgaged Property�r any praperty of Borrower that i s adj acent to the Mortga�ed Property.
