��14��133 <br /> Environmental Permits reguired far the operatian af the Mortgaged <br /> Property in accordance with Hazardous Materials Laws now in eff�ct and <br /> all such Environmental Permits are in full force and effect; no event has <br /> occurred with respect to the Mortgaged Property that canstitutes, ar with <br /> the passing of time ar the gi�ing af Notice w�uld canstitute, <br /> noncompliance with the terms of any En�ironmental Permit; <br /> �5� to the best of Barrovver's l�nowledge after reasona�le and di�igent inquiry, <br /> there are no actinns, suits, cla�rns or pr�ceedings, pending or threaten�d, <br /> that in�ol�e the Mortgaged Pr�perty and a�lege, arise out of, or relate to <br /> any Prohib�ted Acti�ities or C�ndit��ns; and <br /> �6� B�rr�wer has nat rec�i�ed any complaint, order, notice of violation or <br /> other communicatian from any�a�ernmenta� Authority with regard to air <br /> emissions, water discharges, naise emissions or Hazardous Materials, or <br /> any other en�ironmental, health ar safety matters affecting the Mortgaged <br /> Property�r any other pr��erty of Barrower that is adjacent to the <br /> Mortgaged Property that ha�e not previously �een resol�ed �egally. <br /> The representations and v�arranties in th�s Sectian 48 shall be cont�nuing repres�ntations and <br /> warrantie�that shatl be deemed to be made by Borrower throughout the term of the Loan, until <br /> the Indebtedness has been paid in full. <br /> (g} Borrower shall prompt�y notify Lender�n writing upon the occurrence of any of <br /> the follovving events: <br /> �1} Barrovver's disc�very of any Prohibit�d Activities ar Conditions; <br /> (2) Barrower's receipt of or knowledge of any complaint, arder, natice of <br /> �iolati�n or other cammunication from any Governmental Authority or <br /> other persnn w�th regard to present or future alleged Prohibited Act��ities <br /> or Conditions or any other environmental, hea�th or safety matters <br /> affecting the Mortgaged Property ar any�ther property of Borrovver that is <br /> adjacent to the Mortgaged Property; and <br /> �3� any representation�r warranty in this Secti�n 48 becoming untrue aft�r <br /> the date of this Security Instrument. <br /> Any such Notice gi�en by Borrovver shall not relie�e Borravver of, �r result in a vvai�er of, any <br /> obliga�ion under this Secur�ty Instrument,the Nate, or any nther Loan Dacument. <br /> (h} Borrower s�a11 pay promptly the costs of any environmental inspections, tests or <br /> audits ("En�iranmental Inspe�tions"}required by Lender in conn�ction with any f�reclosure or <br /> deed in lieu of fareclosure, or as a�ondition of Lender's consent to any transfer under Secti�n <br /> ��, or requ�red by Lender following a reaso�able determinat��n by Lender that Prohibited <br /> Acti�ities ar Canditions may exist.
