<br /> ;�� p�irsue any and all remedics available by contract , at law or in
<br /> ;�; equity or otherwise , against any contractor , subcontractor ,
<br /> � supplier or other person , in the event of default under any ;
<br /> w� contract entered into in connection with the Pro � ect or in the
<br /> �; event of any breach of warranty with respect to any material ,
<br /> workmanship or guarantee of performance , The Lessee agrees to
<br /> i �� notify the Authority promptly of its exercise of any such remedy
<br /> ;3 and the Authority agrees to cooperate fully with the Lessee in
<br /> { �� prosecuting the same . Zf the Lessee has corrected , at its own
<br /> , ,;y expense , the matter which gave rise to such def3ult or breach ,
<br /> �<� the amount expended by the Lessee for such correction shall be
<br /> �'� paid to the Lessee out of any amount recovered by way of damages ,
<br /> l�i refunds , ad� ustments or otherwise , and tne balance shall be paid
<br /> . ,�:� into the Construction Fund established by the Indenture if received
<br /> i�� during the Construction Period referred to therein , otherwise into
<br /> �4 the Optional Redemption Fund established thereby . If the Lessee
<br /> � has not corrected the matter which gave rise to such default or
<br /> ;;; breach , any amount recovered by way of damages , refunds , ad,� ustments
<br /> ;;' or otherwise , shall be paid intc such Construction Fund if received
<br /> �� during such Construction Period , other•r� ise into such Optional Re -

<br /> �� The agency created by this Section 4 . 1 may be revoked
<br /> ;� by the Authori 'ty upon not less than 10 days ' prior written notice
<br /> :� to the Lessee upon the failure of the Lessee to perform any of
<br /> <� its agreements contained in this Section , as reasonably determined
<br /> � by the Authority , but shall otherwise oe irrevocable and terminate
<br /> ` ', only upon the delivery of the completion certificate referred to
<br /> r in Section 4 . 2 ( b ) hereof or uoon termination of this Lease or the
<br /> ;; Lessee ' s right of possession hereunder pu^suant to Section 9 . z
<br /> ��� hereof or otherwise . ;Jothing contained in this 5ection 4 . 1 shall
<br /> �;:� relieve the Lessee from its obli �ation to pay rent pursuant to

<br /> �';�z: in the Construction Fund shall be disbursed by the Trustee only :

<br /> Trustee with2n 90 days after the completion of tne Pro ,ject the
<br /> '.'';, completion certificate of an Independent Architect reierred to
<br /> ; iz in Section 302 ( D ) of the Indenture .
