2a14036'13 <br />farm vehicles, including, but not limited to, all- terrain vehicles and four- wheelers, may be <br />operated on existing roads in order to gain access to or to cross the Property and in <br />conjunction with agricultural activities allowed by this Conservation Easement and to <br />retrieve hunted game. There shall be no use of off -road vehicles in a manner that results <br />in soil erosion, soil compaction, or in the interference with vegetation or the natural <br />habitat of animal species occurring on the Property, except for permitted ranching <br />purposes. Such use of vehicles for ranching purposes off roadways will be conducted in <br />a manner that has minimal impacts on vegetation and the natural habitat of animal <br />species. <br />3.7. Mineral Extraction. There shall be no exploration, drilling, mining, development, <br />production, extraction, or transportation of minerals, oil, gas, sand, gravel, stone or other <br />mineral substances (whether such other mineral substances be part of the mineral estate <br />or part of the surface estate) on, from, or across the Property ( "Mineral Activities "); <br />provided, however, that this section does not apply to water, which is addressed <br />elsewhere in this Conservation Easement. <br />3.8 Agricultural Use. There shall be no agricultural activities on the Property except <br />as expressly permitted in this Conservation Easement. There shall be no tilling or <br />plowing or use of the Property for commercial cultivation of row crops. Grantee shall <br />have the right to grow and cut hay, harvest seeds, and to conduct interseeding of native <br />plant species. No application of commercial fertilizer or soil supplements may be used in <br />the course of agricultural uses. The permitted agricultural uses are subject to the <br />restrictions contained in this Conservation Easement. <br />3.9. Conservation Measures. Grantee may, but shall not be obligated to, utilize <br />rotational grazing, and any other measures not specifically prohibited herein and may <br />work with the appropriate Natural Resource District(s), Nebraska Game and Parks <br />Commission, and other resource agencies for development of wildlife habitat, rotational <br />grazing, and water development for Permitted Livestock. All conservation program <br />grants, leases, payments and other benefits shall be solely for the use of Grantee. <br />3.10 Intentionally deleted. <br />3.11. Permitted Livestock. "Permitted Livestock" means cattle and other animals <br />which are expressly permitted in writing by the Conservancy. There shall be no animals <br />other than Permitted Livestock raised, maintained or grazed on the property. There shall <br />be no confined animal feedlots permitted on the Property. This prohibition shall not <br />prohibit temporary corrals for retention of Permitted Livestock in relation to activities <br />specifically authorized herein. For purposes of the Agreement, "feedlot" is defined as a <br />permanently constructed confined area or facility within which the Property is not grazed <br />or cropped annually, and which is used and maintained for purposes of engaging in the <br />business of the reception and feeding of Permitted Livestock. Nothing in this section shall <br />prevent Grantee from seasonally confining Grantee's, or Grantee's employees', Permitted <br />Livestock into an area for feeding, and nothing in this section shall prohibit Grantee from <br />Page 9 of 24 Pages <br />
