201403613 <br />3.17 Water. There shall be no manipulation or alteration of rivers, creeks, streams, <br />surface or subsurface springs or other bodies of water or the shorelines thereof or any <br />activities on or uses of the Property detrimental to water purity, quality or quantity. <br />Water resources on the Property shall be used solely for on -site purposes. <br />3.18 Signs. No signs or billboards or other advertising displays are allowed on the <br />Property, except that Grantee may place interpretive signs and "no hunting," "danger," <br />"no trespassing" or similar signs warning of dangers or trespass or for appropriate <br />management of the Property. <br />3.19 Biocides. There shall be no broadcast use of biocides, pesticides, or fertilizers, <br />including but not limited to insecticides, fungicides, rodenticides, fertilizer, and <br />herbicides, except as approved in writing by The Nature Conservancy. Spot or localized <br />treatment with such chemicals is permitted in the following conditions: (a) as may be <br />necessary to eliminate non - native species of plants and insects; (b) to treat Permitted <br />Livestock; (c) to comply with requirements of governmental agencies; (d) as may be <br />accidentally transported to the Property by wind or water from adjoining property; or (e) <br />with the prior written approval of The Nature Conservancy, for management of native or <br />naturalized species. All biocides or pesticides will be used only in strict adherence to use <br />limitations and applications standards established by government regulation. <br />3.20 No Dumping or Waste. There shall be no storage or dumping of trash, garbage, or <br />other unsightly or offensive material, hazardous substance, or toxic waste, nor any <br />placement of underground storage tanks in, on, or under the Property; there shall be no <br />changing of the topography through the placing of soil or other substance or material such <br />as land fill or dredging spoils, nor shall activities be conducted on the Property that could <br />cause erosion or siltation on the Property. <br />3.21 No Pollution. There shall be no pollution of the Property including but not limited <br />to any surface water, natural water courses, lakes, ponds, marshes, subsurface water or any <br />other water bodies. There shall be no activities conducted on the Property that would be <br />detrimental to water purity or that could alter the natural water level or flow in or over the <br />Property. <br />3.22 Nuisance Animals. Grantee shall have the right to control, destroy, or trap <br />nuisance animals which pose a material threat to Conservation Values or to rights <br />expressly held by Grantee by means and methods approved by the Conservancy. The <br />method employed shall be selective and specific to individuals, rather than broadcast, <br />nonselective techniques. <br />3.23 Commercial Development. There shall be no commercial or industrial use of or <br />activity on the Property, other than those relating to agricultural or recreational use <br />including hunting, as permitted herein. No right of passage shall be granted or retained <br />across or upon the Property if that right of passage is used in conjunction with prohibited <br />activities. <br />Page 11 of 24 Pages <br />
