201308332 <br />on the ground floor, not including the garage, provided, however, that no dwelling consisting of a <br />two story design with ceilings that are greater than eight (8) feet high from the floor to ceiling on <br />either the ground or second floor shall have less than 1250 square feet of living area on the <br />ground floor, not including the garage. <br />6. No structure shall be erected, altered, placed or permitted to remain on any lot <br />other than one dwelling, and private garage for not less than two (2) nor more than three (3) cars, <br />for each private dwelling, and any detached garage or other out-buildings incidental to the resi- <br />dential use of the lot. No dwelling shall be erected for occupancy by more than one family, nor <br />shall any dwelling be used for occupancy of more than one family. <br />7. No commercial or business enterprises shall be conducted or operated in said <br />subdivision. No lot or lots shall be divided or split to create smaller building areas. Lots may be <br />combined, or combined and divided, to establish larger building areas. <br />8. Any detached garage or any other out-building shall be constructed of the same <br />quality and materials of construction as the outside finish and roof of the residential structure. <br />Any detached garage shall be a single garage which does not exceed a size that is 15' wide by 24' <br />deep and shall be behind the rear wall of the residential structure. No building shall be con- <br />structed of boxes or other unsightly materials. <br />9. All buildings shall comply with the setback requirements of the building codes <br />and ordinances of the City of Grand Island, Nebraska. All buildings shall be placed back from <br />the center of the front line of the lot at least twenty -five (25) feet or more on all lots. All build- <br />ings shall have minimum setbacks as follows: rear yard- twenty (20) feet; side yard-ten (10) feet; <br />street side yard- twelve and one -half (12'/2) feet. <br />10. No sod, earth, sand, or gravel shall be removed to the injury of the value or of the <br />appearance of any lot, and no unused building material, junk or rubbish shall be left exposed on <br />any lot except during actual building operations. During construction, builders are required to <br />maintain the project and surrounding area in a tidy manner. No trash fires will be allowed on any <br />lot in the subdivision to dispose of discarded construction materials or other debris. <br />11. No sign of any kind shall be displayed to public view on any lot except one sign <br />of not more than five (5) feet square advertising the property for sale or for rent, or signs used by <br />a builder to advertise the property during the construction and sales period, or signs used by the <br />developer to advertise the subdivision. <br />12. No worn out or discarded automobiles, machinery, or parts thereof, shall be stored <br />on any lot in the subdivision and no portion thereof shall be used for automobiles, junk piles or <br />the storage of any kind of discarded items or waste materials. <br />13. Certain easements are established for installation and maintenance of utilities and <br />for drainage, such easements being clearly marked on the recorded plat of said subdivision.
