RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />201308332 <br />Grand Island, Hall County, Nebraska, a tract of land consisting of unplatted land located in the <br />West Half of the Southwest Quarter (W' /2SW'/4) of Section Twelve (12), Township Eleven (11) <br />North, Range Ten (10) West of the 6th P.M., in Hall County, Nebraska, all as surveyed and plat- <br />ted and is more particularly described as recorded in the office of the Register of Deeds of Hall <br />County, Nebraska. The lands submitted to this DECLARATION OF RESTRICTIVE <br />COVENANTS, RESTRICTIONS AND CONDITIONS FOR SUMMERFIELD ESTATES <br />EIGHTH SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, <br />NEBRASKA, include Lots One (1) through Eleven (11), Block One (1), Lots One (1) through <br />Nine (9), Block Two (2) and Lots One (1) through Seven (7), Block Three (3) all in Summerfield <br />Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska. <br />In consideration of the mutual benefits to be derived by the Owner of Summerfield <br />Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska, and any pur- <br />chaser or purchasers, their heirs, devisees, personal representatives, successors, assigns or grant- <br />ees, the Owner stipulates and agrees that all lots in Summerfield Estates Eighth Subdivision in <br />the City of Grand Island, Hall County, Nebraska, that are sold, transferred or conveyed, shall be <br />and are subject to the following restrictive covenants, restrictions and conditions. All restrictive <br />covenants, restrictions and conditions shall run with the land and are as follows: <br />1. All lots in the subdivision shall be known and described as residential lots. <br />2. All construction and building shall be so performed that it will comply with the <br />requirements of the building codes and ordinances of the City of Grand Island, Nebraska. <br />3. No building or dwelling house shall be moved into said subdivision and placed <br />upon a lot. No pre -fab, modular or mobile home shall be placed on a lot; no trailer, tent, garage, <br />shack or any other unsightly out-building shall be used in said subdivision as a dwelling at any <br />time, nor shall any structure of a temporary nature be used as a residence. <br />4. No barns, chicken houses, horse trailers, commercial work or sales shops, or other <br />buildings for the care and housing of fowl, rabbits or livestock shall be placed, maintained or <br />used on any lot; nor shall any fowl, rabbits or animals other than household pets be kept upon <br />any lot, and household pets shall not be kept, bred or maintained for any commercial purposes. <br />No noxious or offensive activity shall be permitted on any lot nor shall there be anything done <br />thereon which may become an annoyance or nuisance to the neighborhood. <br />5. There shall be no townhomes or condominiums on any lot. No basement house or <br />apartment may be built on any lot. No individual dwelling consisting of one level shall be con- <br />structed with less than 1450 square feet of living area, not including the garage. No dwelling <br />consisting of a two story design with ceilings not more than eight (8) feet high from the floor to <br />ceiling on both the ground and second floor shall have less than 1025 square feet of living area <br />2 <br />
