201308332 <br />conditions of the public drainage easements to the City of Grand Island, Nebraska as recorded <br />with the Register Deeds of Hall County, Nebraska and it shall be lawful for any other person or <br />persons owning any real estate in said subdivision to prosecute such proceedings at law or in <br />equity against the person or persons violating or attempting to violate any terms and conditions <br />of such public drainage easements and to prevent him from so doing or to recover damages for <br />such violations. Any owner or owners in the subdivision shall specifically have the right to <br />require any such owner or owners subject to a public drainage easement to the City of Grand <br />Island, Nebraska as recorded with the Register Deeds of Hall County, Nebraska to ensure that the <br />slopes adjacent to the concrete ditch lining do not exceed the allowable slope in the drainage plan <br />for the subdivision and to clear and keep clear the public drainage easement area of structures, <br />fences, trees, brush, hedges and other obstructions that might interfere with the proper flow of <br />storm water. Service lines for individual residences for public utility services which are available <br />to a lot from an underground source shall be kept underground. <br />14. Exposed antennas or aerials of any kind shall not be used except satellite dishes <br />which shall not exceed eighteen (18) inches in diameter. They must not be visible from the street <br />which the front of the primary structure faces and must be attached to the primary structure. No <br />mercury or sodium vapor lights are allowed on any lot. Lighting installed by the City of Grand <br />Island, Nebraska or the State of Nebraska is exempted from all lighting restrictions. <br />15. No campers, trailers, motor or mobile homes, recreational vehicles or trucks larger <br />than a three - quarter (3/4) ton pickup truck shall be stored on any lot, driveway, or on the street in <br />front of or on the side of any lot. No campers, trailers, motor or mobile homes, boats, recrea- <br />tional vehicles or trucks shall be left on the streets overnight. <br />16. The owner of each lot shall keep the vegetation and grass thereon cut to a height <br />less than eight (8) inches prior to construction, and shall keep the shrubs, vegetation and grass <br />thereon cut to a reasonable height after construction. There shall be no cottonwood trees planted. <br />17. No fences shall be constructed, on any lot in the subdivision, of barbed wire, <br />woven wire, or creosote - treated posts above ground or any other unsightly material; provided, <br />however, that a chain link fence not to exceed four (4) feet in height shall be permitted. Privacy <br />fences may not exceed six (6) feet in height. <br />18. All public sidewalks shall be constructed to comply with the requirements of the <br />building codes and ordinances of the City of Grand Island, Nebraska and shall have the edge of <br />such sidewalk furthest from the street one (1) foot inside the street right -of -way unless otherwise <br />required or permitted by the building codes and ordinances of the City of Grand Island, <br />Nebraska. The acceptance of a deed of conveyance by any purchaser or purchasers of any lot or <br />lots shall be construed as consent thereto. Such sidewalks will be constructed not later than the <br />time the home is built and earlier if required by the building codes and ordinances of the City of <br />Grand Island, Nebraska. <br />19. These restrictive covenants, restrictions and conditions are to run with the land <br />and shall be binding on all persons and all parties claiming ownership of said lots, until January <br />4 <br />
