2 01306084 <br />whose custody and welfare will be affected by these proceedings. Plaintiff is a fit and proper <br />person to have the care, custody and control of the minor children and it would be in the best <br />interest of the minor children that legal custody and physical care and control be placed in the <br />Plaintiff. <br />4. CHILD SUPPORT: The parties have reviewed the income guidelines and have <br />taken into consideration the particular set of circumstances and effects herein and are aware of <br />the Nebraska Child Support Guidelines and set the child support to be paid from the Defendant <br />to the Plaintiff. The parties agree that the Defendant shall pay to the Plaintiff, child support in <br />the sum of $390.00 per month for the parties' two minor children commencing on the first day of <br />the month following the date of entry of the Decree of Dissolution and continuing until one of <br />the minor children reaches age 19, becomes emancipated, marries or dies; at which time <br />Defendant shall pay $273.00 per month for the parties' remaining minor child until that child <br />reaches age 19, become emancipated, marries or dies. Both parties further acknowledge that <br />they have been advised that child support may always be changed and modified by the District <br />Court granting this dissolution if there is a change of circumstances of the parties and it is in the <br />best interest of the children that the child support set by the Court be modified. Said payments <br />are to be made to the Nebraska Child Support Payment Center, P.O. Box 82890, Lincoln, <br />Nebraska, for disbursement to the Plaintiff. <br />5. CHILD VISITATION: The parties believe that it would be in the best interest <br />of the minor children that Defendant have. reasonable visitation. <br />6. ALIMONY: The Plaintiff shall not pay alimony to the Defendant and the <br />Defendant shall not pay alimony to the Plaintiff Each party acknowledges that they have been <br />advised and they understand that, unless alimony is awarded in the proceedings presently before <br />the Court , the Decree cannot be subsequently modified at any time to include an award to either <br />ply. <br />7. INCOME TAX RETURNS: The parties shall file separate 2006 Federal and <br />State Income Tax Returns. Plaintiff shall be entitled to claim the tax exemption for Jose Mario <br />Buruca and Defendant shall be entitled to claim the tax exemption for Carmen Emilia Molina if <br />he is current with all of his child support obligations as of the end the year for which the tax <br />exemption is sought to be taken. <br />
