c) Plaintiff shall be responsible for payment of debt owed to Grand Island <br />Clinic, account #5481. <br />13. DEBT EQUALIZATION JUDGMENT: The parties refinanced their home In <br />September, 2005. The new mortgage debt equals or exceeds the fair market value of the <br />property. The refinancing settlement charges totaled $3,483.06. The parties withdrew equity <br />from the house to pay a joint marital debt of $18,086.82 and to pay defendant's child support <br />arrearage in the amount of $609.61. One -half of the settlement charges and of the debt payment <br />and 100 % of defendant's child support arrearage totals $11,394.55. <br />Plaintiff borrowed $9,935.20 from Centris Federal Credit Union to consolidate existing <br />joint martal debt. Defendant is responsible for payment of 1/2 or $4,967.60. <br />In consideration of Plaintiff's assumption of the entire refinanced mortgage and in <br />consideration of Plaintiff assuming responsibility for the entire Centris Federal Credit Union <br />debt, the Court will enter judgment against Defendant in favor of Plaintiff in the amount of <br />$16,362.15 with interest at the rate of 6.849 %. <br />14. ATTORNEY'S FEES AND COURT COSTS: Defendant shall pay $500 to <br />Plaintiff as a partial payment of attorney's fees and court costs incurred in this case. <br />15. NAME CHANGE: The Plaintiff requests that she be allowed to resume use, of <br />her maiden name of Liliana Catalina Molina. <br />16. OTHER PROPERTY: Both Plaintiff and Defendant agree and accept as <br />specifically provided in this agreement, all property of any kind hereafter acquired by the parties <br />and all income and earnings of either of them, shall constitute and be the sole and separate <br />property by whom the property is acquired. All property of any kind hereafter acquired and <br />owned by the parties shall remain in the possession of such party except as provided in this <br />agreement. <br />17. ADVICE OF COUNSEL: Each of the parties expressly certify that they have <br />entered into this agreement upon mature consideration and after ample opportunity to seek the <br />advice of separate counsel; the consent of the execution of this agreement has not been obtained <br />by duress, fraud or undue influence of any person; that no representation of the facts has been <br />made between the parties except as herein set forth; and that the parties agree that this agreement <br />is fair and reasonable and not unconscionable. <br />201306084 <br />
