<br />(a) Any snch agrcements wW not affect the amonnts that Borrower has agreed to pay for Mortgage
<br />Insurance, or any other terma of the Loan. Snch agrcements will not increase the amonnt
<br />Borrower wlll owe for Mortgage Tnsurance, and they will not entftle Borrower to any refnnd.
<br />(b) Any such agreements will not affect the rights Borrower has - if any - with resp�t to the
<br />Mortgage �nsnrance nnder the Homeowners Protect[on Act of 1998 or any other law. These rights
<br />may inclnde the r[ght to receive certafn dYsclosnres, to reqnest and obtain cancellation of the
<br />Mortgage Insurance, to have the Mortgage �nsarance termfnated sutomatically, and/or to receive
<br />a refnnd of any Mortgage Insarance preminms that were ane,am� at the ttme of sach
<br />cancellation or termination.
<br />11. Asslgnment of M Iscellan�ous Pra�eeds; Forfelture. All Miacellaneous Prac�eds ara hereby assigned to
<br />and aha11 be paid to Lender.
<br />ff the Pro�riy is damaged, such Miscellaneous Proceeds shall be applied to restoration or repair of the
<br />Property, if the restoration or repair is economically fe,asible and Lender's security is not lessened. During
<br />such repair and restoration period, Lender shall have the right to hold such Miscellaneous Procceds until
<br />Lender has had an opporhmity to inspect such Properiy to ensura the work has been completed to Lender' s
<br />satisfaction, provided that such inspection shall be undertalceai prompfly. Lender may pay for the repairs and
<br />restoration in a single disbursement or in a series of progress payments as the work is completed. Unless an
<br />agr�t is made in writing or Applicable Law requires interest to be paid on such Miscellaneous Proceeds,
<br />Lender shall not be required to pay Borrower any interest or earnings on such Miscellaneous Proceeds. If the
<br />restoration or repair is not economic�lly feasible or Lender' s security would be lessened, the Miscellaneous
<br />Proc�eds sha11 be applied to the sums secured by tius Security Instrument, whether or not then due, with the
<br />excess, if any, paid to Bonower. S�ch Miscellaneoua Proceeds sha11 be applied in the order provided for in
<br />Section 2.
<br />In the event of a total ta�ng, destruclion, or loss in value of the Property, the Miscell��us Proce�eds sball
<br />be applied to the sums secured by ttus Sacurity Instrument, whether or not then due, with the excess, if any,
<br />paid to Boaowar.
<br />In the event of a partial taking, d�lxuction, or loss in value of the Properiy in wluch the fair market valua of
<br />the Properiy immediately before the partial takirig, de.�truction, or loss in valua is equal to or greater than the
<br />amount of the sums se,cured by this Security Instrument im�cliately before the partial taking, deshruction, or
<br />loss in value, unless Bonower and Lender othervvise agree in writing, the sums s��tted by this Security
<br />Instrument shall be reduc� by the amount of the Miscellaneous Praceeds multiplied by the following
<br />&�action: (a) the total �unt of the sums se�ured immediately bafore the partial taking, de.gfruction, or loss
<br />in value divided bY (b) the fair market value of tha Property immediately before the partial taking,
<br />destruction, ar loss in value. Any balance shall ba paid to Borrower.
<br />In the event of a paztial taking, destruckion, or loss in value of the Property in wluch the fair market value of
<br />the Progerty imn�ediately before tha paitial taking, destruction, or loss in value ia less than the a�unt of the
<br />sums s�ured immediately before the partial t�atiing, de.gtruction, ar loas in value, unless Bonower and
<br />Lender otherwise agree in writing, the Miacellaneous Proceeds shall be applial to the sums secured by this
<br />Security Instrument whether or not the sums are then due.
<br />If the Property is abandon� by Borrower, or i� after notice by Lender to Borrower that the Opposing Party
<br />(as defined in the next sentence) offers to make an avv�azd to settle a claim for damages, Honower fails to
<br />respond to Lender within 30 days after the date the notice is given, Lender is authorized W collect and apply
<br />the Miscellaneous Prace,eds either to restoration or repair of the Property or to the sums secured by this
