2Q1�06300 <br />6. Occupancy. Bonower shall occupy, e.4tablish, and use the Property as Bonower' s principal residence <br />within 60 days after the execution of this Security Tnstr,�.+�„t and shall continue to occupy the Property as <br />Borrower's principal residence for at least one yeaz after the dale of occupancy, unless I,eudez otherwise <br />agrees in writing, which consent shall not be unreasonably withheld, or unless extenuating circumstances <br />exist wluch are beyond Borrower's control. <br />7. Pr�servatlon, Maintenance and Protection of the Property; Inspections. Horrower shall not destroy, <br />damage or impair the Properiy, allow the Property to deteriorate or commit waste on the Properiy. Whether <br />or not Bonower is residing in the Property, Bonower shall maintain the Property in order to prevent the <br />Properiy from deteriorating or decreasing in value due to its condition. Unless it is detarmined pursuant to <br />Section 5 that repair or restoration is not economically feasible, Borrower shall promptly repair the Property <br />if damaged to avoid further deterioratian or damage. If insurance or condemnation proceeds are paid in <br />connection with damage to, ar the taking o� the Property, Bonower shall be responsible for repairing or <br />restoring the Properly only if Lender has rel� prac�cls for such purpfls�. Lender may disburse proceeds <br />far the repairs and restoration in a single payment or in a series of progress payments as the work is <br />completed. If the insitt�anca or condemnation proceads are not su�'icient to repair or r�tore tha Properiy, <br />Borrower ia not relieved of Borrower' s obligation for the co�letion of such repair or restoration. <br />I.ender or its agent may make reasonable entries upon and inspections of the Property. If it has reasonable <br />c�use, Lender may inspe�t the interior of the improvememts on the Properiy. Lender shall giva Bonower <br />notice at the ti� of or prior to such an interior inspe�tion specifying such reasonable c�use. <br />8. Borrowers Loan Appllcatlon. Borrower shall be in dafault i� during the Loan application process, <br />Borrower or any persons or antities acting at the direction of Borrower or with Borrower' s knowledge or <br />consent gave materially false, misleading, or inaccurate information or statements to Lender (or failed to <br />provide Lender with material information) in connaction with the Loan. Material representations include, but <br />are not limited to, representations concerning Borrower' s occupancy of the Properiy as Bonower' s principal <br />residence. <br />9. Prot�tlon af Lender�'s Interest in th� Prop�rty and Rights Under thls SecurHy Instrumerrt. If (a) <br />Horrower faila to perform tha covenants and agreemants contained in tlus Security Instrument, (b) there is a <br />legal Proce�ding that might significantly affect Lender's interest in the Properly and/ar rights under this <br />Sec�mty Instrument (such as a proc�eding in banla uptcy, probate, for condemnarion or forfeiture, for <br />enforcement of a lien which may attain priority over this Sec�rity Instnmdent or to enforce laws or <br />regulations), or (c) Borrower has abandonad the Property, th� Lender may do and pay for whatever is <br />reasonable or appropriate to protect I,ender's intarest in the Property and rights under this Security <br />Instrument, including protecting and/or assessing tha value of the Properiy, and securing and/or repairing <br />the Properiy. Lender' s actions can include, but aze not limited to: (a) paying any sums sacured by a lien <br />which has priority over this Sacurity Inatrument; (b) aPPearing in court; and (c) PaYing reasonable attorneys' <br />f�s to prot�t its interest in the Progeriy and/or iights under this Security �nstrument, including its seaured <br />position in a bankruptcy prace�ing. Securing the Properiy includes, but is not limited to, entering the <br />Properiy to make repairs, change locks, replace or board up doors and windows, drain water from pipes, <br />eliminate building or other code violations or dangerous conditions, and have utilities turned on or off. <br />Although Lender may take action under this Section 9, Lender does not have to do so and is not under any <br />duty or obligation to do so.
