2o�2os3oo <br />(a) Any snch agreementa will not affect the amonnta that Borrower has agre� to pay for Mortgage <br />Insnrance, or any other terms of the Loan. Snch agreements wW not increa�e tLe amonnt <br />Borrower wlll owe for Mortgage Insw�ance, and they will not entitle Borrower to any refnnd. <br />(b) Any snch agreements wID not affect the righte Borrower has - if any - wfth reape�t to the <br />Mortgage Insnrance nnder the Homeowners Protection Act of 1998 or any other law. These rlghts <br />may include the rlght to r�efve certain discloenres, to reqnest and obtain cancellation of the <br />Mortgage Insw�ance, to have the Mortgage �nsurance terminated aatomatically, and/or to receive <br />a refund of any Mortgage Insnrance premiams that were nnearn� at the tlme of such <br />cancellation or terminai3on. <br />11. Asslgnment of M Iscellaneous Pra�ads; Forfeitur+e. All Miscellan�us Procceds are hereby assignad to <br />and sha11 be paid to Lender. <br />If the Properly is damaged, such Miscellan�us Proceeds shall be applied to restora.tion ar repair of the <br />Property, if the restoration or repair is economically feasible and Lender' s security is not lessened. During <br />such repair and restoration period, Lender shall have the right to hold such Miscellan�us Proceeds until <br />Lender l�as had an opporhmity to inspect such Properly to ensure the work hes been completed to Lender' s <br />satisfaction, provided that such inspection shall be undertalcen prompdy. Lender may pay for the repairs and <br />restoration in a single disb�t or in a series of progress gayments as the work is completed. Unless an <br />agr�t is made in writing or Applicable Law requires interest to be paid on such Miscellaneous Proceeds, <br />Lender shall not be required to pay Borrower any interest or earnings on such Miscellaneous Proceeds. If the <br />restoration or repair is not ec;onomically feasible or I.ender' s security would be lessened, the Miscellaneous <br />Proceeds shall be applied to the sums secured by this Sacurity Instrument, whether or not then due, with the <br />accesa, if any, Paid to Borrower. Such Miscellaneous Proceeds shall be applied in the order provided for in <br />Section 2. <br />In the event of a total taking, �ction, or loss in value of the Property, the Miscellaneous Proceeds sha11 <br />be applied to the sums secured by this Sacurity Instmm�ent, whether or not then due, with the excess, if any, <br />paid to Borrower. <br />In the event of a parhial taking, de.�truction, or loss in value of the Properiy in which the fair market value of <br />the Property immediately before tha partial taking, destruction, or loss in value ia equal to or greater than the <br />att�unt of the swns secural by this Security Insl�ment immediately before the partial taking, destruction, or <br />loss in value, unle�s Borrower and I.ender othervvise agr� in writing, the suma se�urefl by thia Security <br />Inst�nt shall be r� by the a�ount of tha Miscellaneaus Proc�ls multiplied by the following <br />fraation: (a) the total amount of the sums secure� immediately before the partial taking, deslruction, or loss <br />in value divided by (b) the fair mazket valua of tha Property immediately before the partial taking, <br />destruction, or loss in value.
