<br /> ARTICLE V
<br /> BUILDING RESTRICTIQNS
<br /> A DEVELOPMENT RESTRICTIONS. The Parties agreo that any
<br /> �xY�:��ment occurrins o�e tlrs Clt�r Parc�! o� �h� IRM Parcel shall be subject to the _
<br /> following restriGtions:
<br /> 1. No building or smacture of any kiud shall be pta�„�d or constnicted upon the
<br /> ssyutherly thirty six(36)feet of the Clcar Parccl which area shall be reserved
<br /> as an access way to prov�de access to end from the rear of the Menard
<br /> Parcel as well as access to the rear of any fiature development occucring an
<br /> the JRM Percel.
<br /> 2. Without the written consent of the owner of the Menard Parcel, no building
<br /> or stcucture shaU be placed or constructed on the Clear Parcel east of a
<br /> nQ�h_�„th tin�,l�cated fiRy (501 feet west of the east face of the e�risting
<br /> Menard store.
<br /> 3. Each Parcel shall contaan minimum 9 foot width parking stalls in sufficient
<br /> number to satisfy the greater of the following requirements:
<br /> �y (i) Mlnimum parking requu�ements of local appGcable municipal codes; �
<br /> ' or
<br /> ; (ri) in the case of a rciail (nonrestaurant)use, there shall be at least five
<br /> ; (5)cars per each one thousand(1,000)gross square feet of building
<br /> area.
<br /> � Z�ii) in the c�se of a restaurant use�there shali be at least nine(9)ctua per
<br /> each�ne thousand(1,000)gross square f�eet of building area.
<br /> (iv) the appJicable requirements of Article VI.B.,C. and�. with respect
<br /> � to thv JRM Par�el.
<br /> B. DAMAGE TO IIViPROV�MENTS. In the evant that any structu� �or
<br /> faci➢ity located on the Parcels shal!be damaged or destroyed(partially or totally)by fire,the
<br /> elements or any casualry,the owner of said parcel,as the case may be. shall promptly,with
<br /> due diligence, repair,rebuild and restore such structwe or fanality to a standard consistent
<br /> with other sim�7ar commercial buildings or faciGties in the Gra�d Island, Nebraska area, or _
<br /> alt�rnatively, sAid owner shall be reqwred to clear, clean and raze the damage structura or
<br /> fnciliry.
<br /> C. FUTURE EXPANSION. In tbe event Menard desires to expand its building
<br /> improvements on the Menard Parcel ar cievelopmont �cCUrs on the JRM Parcel adjacEr�t to -
<br /> the northern Uoundary of the�lear Far�cel, Clear, its successors and assigna, inclusl�ng ar►y
<br /> occupants or lessees of the Cleur Parcel hereby consent to a variance �n the side yard
