Ellinghausen, of Cairo, Hall County, Nebraska, hereinafter referred to as "wife" <br /> and Ronald D. Ellinghausen, of West Point, Cuming County, Nebraska, hereinafter referred to <br /> as "husband". <br /> WHEREAS, the parties were lawfully married on the 8th day of September, 1990, in <br /> Scribner, Dodge County, Nebraska; and <br /> WHEREAS, on the 14th of June, 1995, the husband filed a Petition in the District Court <br /> of Cuming County, Nebraska, Case No. 8796, seeking a dissolution of the aforesaid marriage, <br /> and the wife was served with summons on the 23rd day of June, 1995; and <br /> WHEREAS, the parties hereto have no expectation of resuming marital relations and it <br /> has been determined by the parties that it is impossible for them to continue to live in a marital <br /> state; and <br /> WHEREAS, the parties wish to enter into a voluntary agreement determining their <br /> respective property rights and all other matters reladng to the dissolution of their mairiage <br /> including matters reladng to child custody and support, division of property, payment of debts, <br /> payment of attorney's fees, and other matters incident to the pending dissolution proceedings; and <br /> WHEREAS, each party is aware of his and her right to be represented by legal counsel <br /> and has had the full opportunity to seek counsel and discuss this agreement therewith. <br /> NOW T'HEREFORE, in consideration of the premises and the mutual covenants and <br /> agreements hereinafter contained, the parties agree as follows: <br /> . -� <br /> � EXHIBI�' <br /> � \V <br /> 10-5-qS ° <br /> � <br />� <br />
