JURISDICTION: The parties hereby specifically acknowledge and submit themselves to the jurisdiction of the District Court of Cuming County, Nebraska, for the present time and in the future with regard to all matters relating to the subject matter and rights of the parties under the within agreement. � 2. EFFECTNE DATE: This Agreement shall become binding upon the parties and their respective legal representatives, successors, and assigns immediately following the dissolution of their marriage in the pending proceedings providing that the provisions of this Agreement are approved by the Court. 3. CHILD CUSTODY: The parties are the parents of four (4) minor children, the custody and welfare of whom is affected by these proceedings, to-wit: Chelsea Marie Ellinghausen, born February 17, 1991;Aaron Adolph Ellinghausen,born April 18, 1992;Brandon James Ellinghausen, born August 18, 1993; and Courtney Ann Ellinghausen, born August 17, 1994. The parties are in agreement that the husband is a fit and proper person to be awarded the permanent care,custody and control of Chelsea Marie Ellinghausen, Aaron Adolph Ellinghausen and Brandon James Ellinghausen and that he be awarded their permanent caze, custody and control, subject to rights of reasonable visitation on the part of the wife. The parties are in agreement that the wife is a fit and proper person to be awarded the permanent care, custody and control of Courtney Ann Ellinghausen and that she be awazded her permanent care, custody and control, subject to rights of reasonable visitation on the part of the husband. 4. REMOVAL FROM JURISDICTION: The parties hereby acknowledge that at the present time the husband, as custodial parent of the minor children, Chelsea Marie Ellinghausen, Aaron Adolph Ellinghausen and Brandon James Ellinghausen, resides in rural West Point, Cuming County, Nebraska. If in the future the husband should decide to move from the state of Nebraska with the minor children, he acknowledges that he has been advised and understands that application must be made with the Cuming County District Court prior to the time of such move. The parties hereby acknowledge that at the present time the wife, as custodial parent of the minor child, Courtney Ann Ellinghausen, resides in Cairo, Hall County, Nebraska. If in the future the wife should decide to move from the state of Nebraska with the minor child, she acknowledges that she has been advised and understands that application must be made with the Cuming County District Court prior to the time of such move. �
